AMENDMENT TO HOUSE BILL 5620

2    AMENDMENT NO. ______. Amend House Bill 5620 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-1404 as follows:
 
6    (625 ILCS 5/11-1404)  (from Ch. 95 1/2, par. 11-1404)
7    Sec. 11-1404. Special equipment for persons riding
8motorcycles, motor driven cycles, or mopeds.
9    (a) The operator of a motorcycle, motor driven cycle, or
10moped and every passenger thereon shall be protected by
11glasses, goggles, or a transparent shield.
12    (a-5) In addition to the requirements of subsection (a),
13an operator or passenger of a motorcycle, motor driven cycle,
14or moped who is less than 18 years of age shall be protected by
15a motorcycle helmet.
16    (b) For the purposes of this Section, glasses, goggles,

1motorcycle helmet, and transparent shields are defined as
2follows:
3    "Glasses" means ordinary eye pieces such as spectacles or
4sunglasses worn before the eye, made of shatter-resistant
5material. "Shatter-resistant material", as used in this
6Section, means material so manufactured, fabricated, or
7created that it substantially prevents shattering or flying
8when struck or broken.
9    "Goggles" means a device worn before the eyes, the
10predominant function of which is protecting the eyes without
11obstructing peripheral vision. Goggles shall provide
12protection from the front and sides, and may or may not form a
13complete seal with the face.
14    "Motorcycle helmet" means a protective covering for the
15head consisting of a hard outer shell, padding adjacent to and
16inside the outer shell and a chin-strap type retention system
17with a sticker indicating that the motorcycle helmet meets
18standards established by the United States Department of
19Transportation.
20    "Transparent shield" means a windshield attached to the
21front of a motorcycle that extends above the eyes when an
22operator is seated in the normal, upright riding position,
23made of shatter-resistant material, or a shatter-resistant
24protective face shield that covers the wearer's eyes and face
25at least to a point approximately to the tip of the nose.
26    (c) Contact lenses are not acceptable eye protection
