AMENDMENT TO HOUSE BILL 5289

2    AMENDMENT NO. ______. Amend House Bill 5289 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Human Services Act is
5amended by adding Section 1-41 as follows:
 
6    (20 ILCS 1305/1-41 new)
7    Sec. 1-41. Community-based mental health and substance use
8professionals; coverage for supervision hours. The Department
9of Human Services shall reimburse community-based mental
10health and substance use professionals for hours spent
11providing clinical supervision. As used in this Section,
12"community-based mental health and substance use professional"
13has the same meaning ascribed to that term in Section 5-52 of
14the Illinois Public Aid Code.
 
15    Section 10. The Illinois Public Aid Code is amended by

1adding Section 5-52 as follows:
 
2    (305 ILCS 5/5-52 new)
3    Sec. 5-52. Community-based mental health and substance use
4professionals; coverage for supervision hours.
5    (a) As used in this Section, "community-based mental
6health and substance use professional" means a licensed
7practitioner of the healing arts as defined in 89 Ill. Adm.
8Code 140.453.
9    (b) The medical assistance program, including both the
10fee-for-service and managed care medical assistance programs
11established under this Article, shall reimburse
12community-based mental health and substance use professionals
13for hours spent providing clinical supervision. The Department
14shall amend 89 Ill. Adm. Code 140.453 to allow clinical
15supervision provided by a licensed practitioner of the healing
16arts to be a covered service in accordance with the provisions
17of this subsection.
18    (c) By January 1, 2025, the Department shall submit to the
19Joint Committee on Administrative Rules a rulemaking proposal
20to implement this Section as soon as practicable.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
