SYNOPSIS AS INTRODUCED:
 
775 ILCS 55/1-40 new

    Amends the Reproductive Health Care Act. Prohibits the State from providing any information or expending or using any time, money, facilities, property, equipment, personnel, or other resources in furtherance of any interstate investigation or proceeding seeking to impose civil or criminal liability upon a person or entity for: (1) the provision, receipt, or seeking of or inquiring or responding to an inquiry about reproductive health care products or services that are lawful in Illinois; or (2) assisting, advising, aiding, abetting, facilitating, soliciting, or conspiring with any person or entity providing, receiving, seeking, or inquiring or responding to an inquiry about reproductive health care products or services that are lawful in Illinois. Exempts any investigation or proceeding if the conduct subject to potential liability under the investigation or proceeding would be subject to criminal or civil liability under the laws of Illinois.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Reproductive Health Act is amended by
5adding Section 1-40 as follows:
 
6    (775 ILCS 55/1-40 new)
7    Sec. 1-40. Prohibited State actions. The State shall not
8provide any information or expend or use any time, money,
9facilities, property, equipment, personnel, or other resources
10in furtherance of any interstate investigation or proceeding
11seeking to impose civil or criminal liability upon a person or
12entity for:
13    (1) the provision, receipt, or seeking of, or inquiring or
14responding to an inquiry about reproductive health care
15products or services that are lawful in Illinois; or
16    (2) assisting, advising, aiding, abetting, facilitating,
17soliciting, or conspiring with any person or entity providing,
18receiving, seeking, or inquiring or responding to an inquiry
19about reproductive health care products or services that are
20lawful in Illinois.
21    This Section does not apply to any investigation or
22proceeding if the conduct subject to potential liability under
23the investigation or proceeding would be subject to criminal
