SYNOPSIS AS INTRODUCED:
 
20 ILCS 2905/5 new

    Amends the State Fire Marshal Act. Requires the Office of the State Fire Marshal to adopt amendments to its permanently moored craft fire prevention and safety rules to provide for waivers, conditional waivers, limits to inspection and examination requirements, and reductions in the frequency of inspections and examinations for deck barges used as permanently moored craft in water that is no deeper than half of the barge's hull depth. Describes criteria that may be considered by the Office when amending its rules. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Fire Marshal Act is amended by adding
5Section 5 as follows:
 
6    (20 ILCS 2905/5 new)
7    Sec. 5. Amendments to permanently moored craft fire
8prevention and safety rules. Notwithstanding any other
9provision of law, within one year after the effective date of
10this amendatory Act of the 103rd General Assembly, the Office
11shall adopt amendments to the permanently moored craft fire
12prevention and safety rules codified at 41 Ill. Adm. Code Part
13149 in order to provide for waivers, conditional waivers,
14limits to inspection and examination requirements, and
15reductions in the frequency of inspections and examinations
16for deck barges used as permanently moored craft in water that
17is no deeper than half of the barge's hull depth.
18The amendments adopted by the Office under subsection (a) may
19provide waivers, limits on inspection and examination
20requirements, and reductions in the frequency of inspections
21and examination on the basis of the location, age, condition,
22size, history, purpose, and occupancy of the deck barge and
23other factors deemed by the Office as appropriate to consider

1while ensuring the safe condition of the permanently moored
2craft and its occupants.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.
