SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/17-5.8 new

    Amends the Criminal Code of 2012. Provides that any person legally authorized to treat, transport, or store human remains, except as authorized by law, shall not: (1) knowingly and intentionally provide inaccurate documentation of the identity of human remains to an individual or organization; (2) knowingly and intentionally store human remains in violation of Illinois law; or (3) knowingly and intentionally provide an individual or organization with human remains that are intentionally misidentified. Provides that a violation is a Class 4 felony.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by adding
5Section 17-5.8 as follows:
 
6    (720 ILCS 5/17-5.8 new)
7    Sec. 17-5.8. Mishandling of human remains.
8    (a) Any person legally authorized to treat, transport, or
9store human remains, except as authorized by law, shall not:
10        (1) knowingly and intentionally provide inaccurate
11    documentation of the identity of human remains to an
12    individual or organization;
13        (2) knowingly and intentionally store human remains in
14    violation of Illinois law; or
15        (3) knowingly and intentionally provide an individual
16    or organization with human remains that are intentionally
17    misidentified.
18    (b) Sentence. A person who violates this Section is guilty
19of a Class 4 felony.
