AMENDMENT TO HOUSE BILL 4718

2    AMENDMENT NO. ______. Amend House Bill 4718 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. Property. In consideration of the lands 
5reserved for Chief Shab-eh-nay by the Treaty of Prairie du 
6Chien of July 29, 1829, as well as the Prairie Band Potawatomi 
7Nation's historic connection to those lands and the 
8surrounding area, the Director of Natural Resources, on behalf 
9of the State of Illinois, is authorized to execute and deliver 
10to the Prairie Band Potawatomi Nation, for and in 
11consideration of $1 paid to the Department of Natural 
12Resources, a quit claim deed to the following described real 
13property comprising all of the lands within Shabbona Lake and 
14State Park, located in DeKalb County, owned by the State of 
15Illinois:

7    Quarter of the Southeast Quarter of Section 26, Township 
8    38 North, Range 3 East of the Third Principal Meridian, 
9    according to the plat thereof recorded in Book "A" of 
10    Plats, Page 19, that lies East of the East line of Lot 2 of 
11    Lot 4 and Northerly of a line 200 feet Northwesterly of and 
12    parallel to the center line of the main track of the 
13    Chicago and North Western Railway Company, a corporation 
14    of Wisconsin.
15    Situated in the County of DeKalb in the State of Illinois.
 
16    Section 10. Conveyance. 
17    (a) Subject to the conditions set forth in subsections 
18(b), (c), and (d), the Director of Natural Resources, on 
19behalf of the State of Illinois and the Department of Natural 
20Resources, shall convey by quit claim deed all right, title, 
21and interest of the State of Illinois and the Department of 
22Natural Resources in and to the real property described in 
23Section 5 to the Prairie Band Potawatomi Nation.
24    (b) The conveyance of real property authorized by Section 
255 shall be made so long as the conveyance to the Prairie Band

1Potawatomi Nation does not violate any federal funding 
2restrictions, nor violate the terms of any federal grant, nor 
3require the Department to reimburse, refund, or provide 
4replacement land to the federal government (U.S. Fish and 
5Wildlife Service, National Park Service, or the U.S. 
6Department of the Interior) for federal grant funds awarded to 
7the Department to acquire property, construct infrastructure 
8and enhance the natural habitat or provide recreational 
9opportunities for public use at the Shabbona Lake and State 
10Park.
11    (c) The conveyance of real property authorized by Section 
125 shall be made so long as the Department of Natural Resources 
13and the Prairie Band of the Potawatomi Nation enter into a land 
14management agreement pursuant to Section 3b of the State Parks 
15Act.
16    (d) The conveyance of real property authorized by Section 
175 shall be made subject to existing public utilities, existing 
18public roads, and any and all reservations, easements, 
19encumbrances, licenses, covenants, and restrictions of record.
 
20    Section 15. Recording. The Director of Natural Resources 
21shall obtain a certified copy of this Act within 60 days after 
22its effective date. The Department of Natural Resources shall 
23ensure that a certified copy of this Act and any quit claim 
24deed executed pursuant to this Act that is provided to the 
25Prairie Band Potawatomi Nation shall be recorded by the

1Prairie Band Potawatomi Nation in the Recorder's Office of the 
2county in which the land is located.
 
3    Section 90. The State Parks Act is amended by adding 
4Section 3b as follows:
 
5    (20 ILCS 835/3b new)
6    Sec. 3b. Shabbona Lake and State Park; land management 
7agreement.
8    (a) The Department of Natural Resources may enter into a 
9land management agreement with the Prairie Band Potawatomi 
10Nation and other necessary parties for the purpose of 
11managing, maintaining, or operating the real property conveyed 
12to the Prairie Band Potawatomi Nation by this amendatory Act 
13of the 103rd General Assembly. Any such agreement shall 
14contain the purpose, powers, rights, objectives, and 
15responsibilities of each contracting party and a requirement 
16that the land conveyed by this amendatory Act of the 103rd 
17General Assembly remain open for public recreation during the 
18term of any such agreement. All agreements entered into 
19pursuant to this Section shall be subject to the written 
20approval of the Director of Natural Resources.
21    (b) Subject to appropriation, the Department of Natural 
22Resources may use State resources for the management, 
23maintenance, and operation of the real property conveyed to 
24the Prairie Band Potawatomi Nation by this amendatory Act in

1accordance with the land management agreement that it executes 
2with the Prairie Band Potawatomi Nation under this Section.
3    (c) In this Section, "land management agreement" means one 
4or more agreements, or set of agreements, made for the purpose 
5of managing, maintaining, or operating the real property 
6conveyed to the Prairie Band Potawatomi Nation by this 
7amendatory Act of the 103rd General Assembly.
 
8    Section 99. Effective date. This Act takes effect upon 
9becoming law.".
