SYNOPSIS AS INTRODUCED:
 
    Authorizes the Director of Natural Resources to execute and deliver a quitclaim deed to the Prairie Band Potawatomi Nation for specified real property located in DeKalb County, subject to specified conditions. Effective immediately.

1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. In consideration of the lands reserved for
5Chief Shab-eh-nay by the Treaty of Prairie du Chien of July 29,
61829, as well as the Prairie Band Potawatomi Nation's historic
7connection to those lands and the surrounding area, the
8Director of Natural Resources, on behalf of the State of
9Illinois, shall convey to the Prairie Band Potawatomi Nation a
10quit claim deed to the Shabbona Lake State Park located in
11DeKalb County namely:
 
12    Parcels 13-22-200-008, 13-22-200-009, 13-22-200-010,
13    13-23-300-008, 13-23-400-012, 13-25-100-014,
14    13-26-100-015, 13-26-100-016, 13-27-200-004, so long as
15    the conveyance to the Prairie Band Potawatomi Nation does
16    not violate any federal funding restrictions, nor violate
17    the terms of any federal grant, nor require the Department
18    to reimburse, refund, or provide replacement land to the
19    federal government (U.S. Fish and Wildlife Service,
20    National Park Service, or the U.S. Department of the
21    Interior) for federal grant funds awarded to the
22    Department to acquire property, construct infrastructure
23    and enhance the natural habitat or provide recreational

1    opportunities for public use at the Shabbona Lake State
2    Park.
 
3    Section 10. The conveyance of real property authorized by
4Section 5 shall be made subject to existing public utilities,
5existing public roads, and any and all reservations,
6easements, encumbrances, covenants, and restrictions of
7record.
 
8    Section 15. The Director of Natural Resources shall obtain
9a certified copy of this Act within 60 days after its effective
10date. The Department of Natural Resources shall ensure that a
11certified copy of this Act and any quit claim deed executed
12pursuant to this Act that is provided to the Prairie Band
13Potawatomi Nation shall be recorded by the Prairie Band
14Potawatomi Nation in the Recorder's Office of the county in
15which the land is located.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.
