SYNOPSIS AS INTRODUCED:
 
225 ILCS 85/50 new
    Amends the Pharmacy Practice Act. Provides that, in accordance with a standing order by a physician licensed to practice medicine in all its branches or a standing order by the Department of Public Health, a pharmacist may provide a school district, public school, charter school, or nonpublic school with undesignated epinephrine injectors, asthma medication, glucagon, and opioid antagonists for the use by the school district, public school, charter school, or nonpublic school under the School Code. Provides that the Department of Public Health shall issue a standing order to provide a school district, public school, charter school, or nonpublic school with undesignated epinephrine injectors, asthma medication, glucagon, and opioid antagonists for use under the School Code. Provides that the standing order must be consistent with the current version of the guidelines of the Centers for Disease Control and Prevention, guidelines of the United States Preventive Services Task Force, or generally recognized evidence-based clinical guidelines. Sets forth provisions concerning liability and rulemaking.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly:
 
4    Section 5. The Pharmacy Practice Act is amended by adding 
5Section 50 as follows:
 
6    (225 ILCS 85/50 new)
7    Sec. 50. Standing order and dispensation of medication to 
8schools.
9    (a) In accordance with a standing order by a physician 
10licensed to practice medicine in all its branches or a 
11standing order by the Department of Public Health, a 
12pharmacist may provide a school district, public school, 
13charter school, or nonpublic school with undesignated 
14epinephrine injectors, asthma medication, glucagon, and opioid 
15antagonists for use by the school district, public school, 
16charter school, or nonpublic school under Section 22-30 of the 
17School Code. A pharmacist and pharmacy must maintain records 
18of medications issued under this Section pursuant to a 
19standing order.
20    (b) The Department of Public Health shall issue a standing 
21order to provide a school district, public school, charter 
22school, or nonpublic school with undesignated epinephrine 
23injectors, asthma medication, glucagon, and opioid antagonists

1for use under Section 22-30 of the School Code. The standing 
2order must be consistent with the current version of the 
3guidelines of the Centers for Disease Control and Prevention, 
4guidelines of the United States Preventive Services Task 
5Force, or generally recognized evidence-based clinical 
6guidelines.
7    (c) No employee of the Department of Public Health issuing 
8a standing order pursuant to this Section shall, as a result of 
9the employee's acts or omissions in issuing the standing order 
10pursuant to this Section, be subject to (i) any disciplinary 
11or other adverse action under the Medical Practice Act of 
121987, (ii) any civil liability, or (iii) any criminal 
13liability.
14    (d) The Department may adopt rules to implement this 
15Section.
