AMENDMENT TO HOUSE BILL 4196

2    AMENDMENT NO. ______. Amend House Bill 4196 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 9.20 as follows:
 
6    (415 ILCS 5/9.20 new)
7    Sec. 9.20. Fleet Electrification Incentive Program.
8    (a) In this Section:
9    "Eligible electric vehicle" means an electric truck or
10electric school bus categorized by the United States
11Environmental Protection Agency Emissions Classifications,
12using gross vehicle weight ratings, as a Class 2b, 3, 4, 5, 6,
137, or 8 vehicle, with or without a properly ventilated,
14conventionally powered heater.
15    "Eligible purchaser" means a person who the Agency
16determines:

1        (1) is the purchaser of an eligible electric vehicle
2    that is registered in this State or recognized under the
3    International Registration Plan;
4        (2) is domiciled in this State;
5        (3) in the case of a purchaser who is the lessee of an
6    eligible electric vehicle, is the lessee of the vehicle
7    for a term of at least 60 months; and
8        (4) has demonstrated, to the satisfaction of the
9    Agency, that the eligible electric vehicle will operate
10    within the State for at least 80% of its operational hours
11    once purchased and delivered.
12    "Equity investment eligible community" has the meaning
13given in the Energy Transition Act.
14    "Program" means the Fleet Electrification Incentive
15Program established under this Section.
16    "Purchaser" means a fleet owner, operator, or provider
17that will operate or manage the vehicle for a minimum of 5
18years after receipt of the vehicle, whether through lease or
19direct purchase.
20    (b) To promote the use of eligible electric vehicles, the
21Agency shall establish, by rule, a Fleet Electrification
22Incentive Program through which it provides eligible
23purchasers a grant of up to the following base amounts for the
24purchase of an eligible electric vehicle:
25        (1) $7,500 for a Class 2b vehicle;
26        (2) $45,000 for a Class 3 vehicle;

1        (3) $60,000 for a Class 4 or Class 5 vehicle;
2        (4) $85,000 for a Class 6 or Class 7 vehicle; and
3        (5) $120,000 for a Class 8 vehicle.
4    In addition, the Agency shall offer increased grant
5incentives of an additional 65% of the base amount for the
6purchase of a school bus that will serve a public school
7district.
8    (c) The Agency shall award grants under the Program to
9eligible purchasers on a competitive basis according to the
10availability of funding. The Agency shall use a points-based
11quantitative evaluation to be determined by the Agency by
12rule.
13    The Agency shall award additional points to an application
14from an eligible purchaser whose eligible electric vehicles
15are to be domiciled in an equity investment eligible
16community.
17    The Agency shall also award additional points to an
18eligible purchaser who has negotiated and entered into a
19collective bargaining agreement at the time of application for
20the grant.
21    (d) A grant provided under the Program is limited to a
22maximum award of 80% of the purchase price per eligible
23electric vehicle. Multiple eligible electric vehicles may be
24included in each grant under the Program. An eligible
25purchaser may be awarded multiple grants under the Program;
26however, the Agency shall have the authority to implement, by

1rule, a limit on the number of grants awarded to each
2purchaser.
3    (e) An eligible purchaser shall enter into a grant
4agreement with the Agency upon notification from the Agency
5that the eligible purchaser's application has been approved.
6Grants under this Section shall be provided by the Agency with
7the submittal of a paid invoice for reimbursement. An eligible
8purchaser participating in the Program shall retain ownership
9of the eligible electric vehicle and meet all applicable
10project requirements for a minimum 5-year period after the
11date the eligible purchaser receives the vehicle. Resale of an
12eligible electric vehicle may be allowed within the 5-year
13period if necessitated by unforeseen or unavoidable
14circumstances with approval from the Agency. The Agency shall
15ensure the resale of an eligible electric vehicle serving a
16public school or located within an equity investment eligible
17community shall result in the vehicle servicing a similarly
18situated community.
19    (f) The deployment of the eligible electric vehicle in the
20purchaser's fleet is required within 24 months after receipt
21of notice of approval of the purchaser's Program application.
22Total completion of the project for which the eligible
23electric vehicle is purchased or leased must occur within 36
24months after receipt of grant funds under the Program.
25    (g) A grant under this Section may be combined with other
26public incentives to support fleet purchasing decisions.

1Receipt of any other public incentive for an eligible electric
2vehicle shall not preclude a purchaser from being awarded a
3grant under this Section. However, the combined total of
4governmental incentives, including, but not limited to, tax
5credits, grants, or vouchers, shall not exceed 80% of the
6purchase price of the vehicle.
7    (h) The Agency shall set aside 20% of the appropriated
8funds under the Program for grants to the eligible purchaser
9of an electric school bus.
10    (i) All awards granted under this Section are subject to
11appropriation by the General Assembly.".
