SYNOPSIS AS INTRODUCED:
 
430 ILCS 69/35-45 new

    Amends the Reimagine Public Safety Act. Provides that subject to appropriation, the Office of Firearm Violence Prevention shall create an assault weapon and large capacity ammunition feeding device buyback program. Provides that subject to appropriation, the Office of Firearm Violence Prevention shall purchase operable assault weapons and large capacity ammunition feeding devices from the owners of those weapons and devices who wish to sell them to the State. Provides that permanently inoperable assault weapons or large capacity ammunition feeding devices are ineligible for the buyback program. Provides that the buyback program shall permit the owners of firearms that are not assault weapons to participate in the buyback program. Provides that firearms and large capacity ammunition feeding devices purchased at the buyback program shall be delivered to the Illinois State Police who may: (1) destroy the firearms and devices; (2) use them for training or other Illinois State Police purposes; or (3) transfer them to municipal and county law enforcement agencies for their use. Provides that the Department of Human Services shall adopt rules to implement the program.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Reimagine Public Safety Act is amended by
5adding Section 35-45 as follows:
 
6    (430 ILCS 69/35-45 new)
7    Sec. 35-45. Assault weapons and large capacity ammunition
8feeding devices buyback program.
9    (a) In this Section, "assault weapon" and "large capacity
10ammunition feeding device" have the meanings ascribed to them
11in Section 24-1.9 or 24-1.10 of the Criminal Code of 2012,
12respectively and includes any additional identified assault
13weapons designated as such by the Illinois State Police.
14    (b) Subject to appropriation, the Office of Firearm
15Violence Prevention shall create an assault weapon and large
16capacity ammunition feeding device buyback program.
17    (c) Subject to appropriation, the Office of Firearm
18Violence Prevention shall purchase operable assault weapons
19and large capacity ammunition feeding devices from the owners
20of those weapons and devices who wish to sell them to the
21State. Permanently inoperable assault weapons or large
22capacity ammunition feeding devices are ineligible for the
23buyback program.

1    (d) The buyback program shall permit the owners of
2firearms that are not assault weapons to participate in the
3buyback program.
4    (e) Firearms and large capacity ammunition feeding devices
5purchased at the buyback program shall be delivered to the
6Illinois State Police who may:
7        (1) destroy the firearms and devices;
8        (2) use them for training or other Illinois State
