SYNOPSIS AS INTRODUCED:
 
5 ILCS 375/5.5 new

    Amends the State Employees Group Insurance Act of 1971. Sets forth requirements for programs of group health benefits administered by the Department of Central Management Services for annuitants, retired TRS benefit recipients, or retired community college benefit recipients. Provides that if, on the effective date of the amendatory Act, the Director of Central Management Services has procured fewer than 2 contracts that provide a program of group health benefits for annuitants, retired TRS benefit recipients, or retired community college benefit recipients, then, as soon as possible after the effective date of the amendatory Act, the Director shall procure additional contracts that provide a program of group health benefits so that there are at least 2 contracts that provide a program of group health benefits for the respective beneficiaries. Provides that thereafter, the Director shall ensure that there are at least 2 contracts procured that provide a program of group health benefits for annuitants, retired TRS benefit recipients, and retired community college benefit recipients.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Employees Group Insurance Act of 1971
5is amended by adding Section 5.5 as follows:
 
6    (5 ILCS 375/5.5 new)
7    Sec. 5.5. Annuitant health benefits; group program
8requirements.
9    (a) All programs of group health benefits administered by
10the Department of Central Management Services for annuitants,
11retired TRS benefit recipients, or retired community college
12benefit recipients shall be subject to the following
13requirements:
14        (1) 90 days before the expiration of a current
15    contract for a program of group health benefits, the
16    Department of Central Management Services shall notify the
17    Commission when the request for proposal process shall
18    commence for that benefits program to be offered in the
19    next fiscal year.
20        (2) Concurrent with the notice required under
21    paragraph (1), the Department of Central Management
22    Services shall disclose to the Commission information
23    regarding the request for proposal rating process,

1    including, but not limited to, documents, reports of
2    negotiations, bid invitations, requests for proposals,
3    specifications, copies of proposed and final contracts or
4    agreements, and any other materials concerning contracts
5    or agreements for proposed benefit programs.
6        (3) The request for proposal process shall include a
7    regional analysis to determine if an applicant is unable
8    to provide coverage for annuitants or retirees in any area
9    of this State.
10    (b) For each program of health benefits for annuitants or
11retirees that is subject to the requirements of this Section,
12the Department of Central Management Services shall conduct a
13poll of at least 10% of current benefit recipients to measure
14satisfaction with their program of group health benefits. The
15form and methods of this poll shall be approved by the
16Director. The results of the recipient satisfaction polls
17shall be disclosed to the Commission and that poll information
18may be used by the Commission to hold a public hearing. A
19contract for any program of group health benefits subject to
20this Section may not be selected for the next fiscal year until
21the Commission holds a hearing on member satisfaction pursuant
22to this subsection (b).
23    (c) If, on the effective date of this amendatory Act of the
24103rd General Assembly, the Director has procured fewer than 2
25contracts that provide any program of group health benefits
26for annuitants, retired TRS benefit recipients, or retired

1community college benefit recipients, then, as soon as
2possible after the effective date of this amendatory Act of
3the 103rd General Assembly, the Director shall procure
4additional contracts that provide that program of group health
5benefits so that there are at least 2 contracts that provide a
6program of group health benefits. Thereafter, the Director
7shall ensure that there are at least 2 contracts procured that
8provide that program of group health benefits for annuitants,
9retired TRS benefit recipients, or retired community college
10benefit recipients.
