AMENDMENT TO HOUSE BILL 3337

2    AMENDMENT NO. ______. Amend House Bill 3337 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Municipal Code is amended by
5changing Section 3.1-25-95 and by adding Section 5-2-20 as
6follows:
 
7    (65 ILCS 5/3.1-25-95)  (from Ch. 24, par. 3.1-25-95)
8    Sec. 3.1-25-95. Incorporated town officers.
9    (a) For each the general municipal election in the Town of
10Cicero, to be held in the year 1985 in every incorporated town
11with a population of 25,000 or more by the last official
12census, and every 4 years thereafter, the municipal clerk
13shall certify the names of the candidates to the proper
14election authority as provided by the general election law. A
15president, a clerk, an assessor, a collector, and a supervisor
16shall be elected for a term of 4 years and until their

1successors are elected and have qualified. Whenever a vacancy
2occurs in the office of any of the specified officers, the
3vacancy shall be filled for the remainder of the term at the
4next general municipal election in that incorporated town as
5provided in Section 3.1-10-50. Whenever an election is held
6for this purpose, the municipal clerk shall certify the office
7to be filled and the candidates for that office to the election
8authorities as provided in the general election law. During
9the period from the time a vacancy occurs until a clerk,
10assessor, collector, or supervisor is elected and has
11qualified, the vacancy may be filled by appointment by the
12president and board of trustees of that incorporated town
13voting jointly. During the period from the time a vacancy
14occurs until a president is elected and has qualified, the
15vacancy may be filled by appointment by the board of trustees
16of that incorporated town.
17     (b) For every other incorporated town other than the Town
18of Cicero with a population of 25,000 or more by the last
19decennial census, a president must be elected every 4 years at
20the general municipal election with other officers to be
21elected or appointed as set forth by ordinance of the
22corporate authorities. Each officer shall continue to hold
23office until the officer's successor is selected and
24qualified. Each vacancy must be filled under Section
253.1-10-50.
26    (c) The changes made to subsection (a) by this amendatory

1Act of the 103rd General Assembly are declarative of existing
2law and shall be applied retroactively when substantively
3applicable, including all pending actions without regard to
4when the cause of action accrued.

9must be elected every 4 years at the general municipal
10election with other officers to be elected or appointed as set
11forth by ordinance of the corporate authorities. Each officer

13selected and qualified. Each vacancy must be filled under
14Section 3.1-10-50.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
