65 ILCS 5/5-2-17  from Ch. 24, par. 5-2-17

    Amends the Illinois Municipal Code. In provisions about certain villages incorporated under special Acts, adds incorporated towns into the provisions to allow incorporated towns to elect 6 trustees. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Section 5-2-17 as follows:
 
6    (65 ILCS 5/5-2-17)  (from Ch. 24, par. 5-2-17)
7    Sec. 5-2-17. Trustees; certain villages and towns
8incorporated under special Acts.
9    (a) In every village specified in Section 5-2-12 or
10incorporated town incorporated and existing under any special
11Act that, before June 4, 1909, under any special Act, annually
12elected members of its legislative body, the electors of the
13municipality village, instead of the legislative body now
14provided for by law, shall elect 6 trustees. They shall hold
15their offices until their respective successors are elected
16and have qualified. At the first meeting of this board of 6
17trustees, the terms of office of the trustees shall be
18staggered. Thereafter, the terms shall be for the same length
19of time as provided for alderpersons in Section 3.1-20-35.
20    (b) The electors of a village or incorporated town
21described in subsection (a) may, however, adopt a 2 year term
22for their trustees as provided in Section 3.1-10-65. If this 2
23year term is adopted, then at the next general municipal

1election in the adopting village, 3 trustees shall be elected,
2and they shall hold their offices for terms of one year each.
3In the next succeeding year, and in each year thereafter, 3
4trustees shall be elected in the adopting village, and they
5shall hold their offices for terms of 2 years each.
6    (c) Any village or incorporated town described in
7subsection (a) that, before January 2, 1942, has adopted a 2
8year term for its trustees and is now electing 3 trustees each
9year shall continue to elect 3 trustees each year for a term of
102 years each. Any municipality village described in subsection
11(a) that, before January 2, 1942, has adopted a 2 year term for
12its trustees but is not now electing 3 trustees each year shall
13elect 3 trustees at the next general municipal election in
14that village, and they shall hold their offices for terms of
15one year each. In the next succeeding year, and in each year
16thereafter, 3 trustees shall be elected, and they shall hold
17their offices for terms of 2 years each.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.
