AMENDMENT TO HOUSE BILL 3060

2    AMENDMENT NO. ______. Amend House Bill 3060 on page 1,
3line 4, after "by", by inserting "changing Section 2 and by";
4and
 
5on page 1, immediately below line 5, by inserting the
6following:
 
7    "(210 ILCS 40/2)  (from Ch. 111 1/2, par. 4160-2)
8    Sec. 2. As used in this Act, unless the context otherwise
9requires:
10    "At-home continuing care" means an agreement to provide a
11person with services and supports based upon the person's
12needs and coordinated by a case manager, including services
13provided to the person in his or her residence and services of
14the community's affiliated facilities.
15    "At-home continuing care resident" means an at-home
16continuing care agreement holder who resides in a private

1residence outside of the continuing care retirement community
2campus.
3    (a) "Department" means the Department of Public Health.
4    (b) "Director" means the Director of the Department.
5    (c) "Life care contract" means a contract to provide to a
6person for the duration of such person's life or for a term in
7excess of one year, nursing services, medical services or
8personal care services, in addition to maintenance services
9for such person in a facility, conditioned upon the transfer
10of an entrance fee to the provider of such services in addition
11to or in lieu of the payment of regular periodic charges for
12the care and services involved.
13    (d) "Provider" means a person who provides services
14pursuant to a life care contract.
15    (e) "Resident" means a person who enters into a life care
16contract with a provider, or who is designated in a life care
17contract to be a person provided with maintenance and nursing,
18medical or personal care services.
19    (f) "Facility" means a place or places in which a provider
20undertakes to provide a resident with nursing services,
21medical services or personal care services, in addition to
22maintenance services for a term in excess of one year or for
23life pursuant to a life care contract. The term also means a
24place or places in which a provider undertakes to provide such
25services to a non-resident.
26    (g) "Living unit" means an apartment, room or other area

1within a facility set aside for the exclusive use of one or
2more identified residents.
3    (h) "Entrance fee" means an initial or deferred transfer
4to a provider of a sum of money or property, made or promised
5to be made by a person entering into a life care contract,
6which assures a resident of services pursuant to a life care
7contract.
8    (i) "Permit" means a written authorization to enter into
9life care contracts issued by the Department to a provider.
10    (j) "Medical services" means those services pertaining to
11medical or dental care that are performed in behalf of
12patients at the direction of a physician licensed under the
13Medical Practice Act of 1987 or a dentist licensed under the
14Illinois Dental Practice Act by such physicians or dentists,
15or by a registered or licensed practical nurse as defined in
16the Nurse Practice Act or by other professional and technical
17personnel.
18    (k) "Nursing services" means those services pertaining to
19the curative, restorative and preventive aspects of nursing
20care that are performed at the direction of a physician
21licensed under the Medical Practice Act of 1987 by or under the
22supervision of a registered or licensed practical nurse as
23defined in the Nurse Practice Act.
24    (l) "Personal care services" means assistance with meals,
25dressing, movement, bathing or other personal needs or
26maintenance, or general supervision and oversight of the

1physical and mental well-being of an individual, who is
2incapable of maintaining a private, independent residence or
3who is incapable of managing his person whether or not a
4guardian has been appointed for such individual.
5    (m) "Maintenance services" means food, shelter and laundry
6services.
7    (n) "Certificates of Need" means those permits issued
8pursuant to the Illinois Health Facilities Planning Act as now
9or hereafter amended.
10    (o) "Non-resident" means a person admitted to a facility
11who has not entered into a life care contract.
