AMENDMENT TO HOUSE BILL 2998

AMENDMENT NO. ______. Amend House Bill 2998 by replacing everything after the enacting clause with the following:

"Section 5. The Mental Health and Developmental Disabilities Administrative Act is amended by adding Section 70.1 as follows:

(20 ILCS 1705/70.1 new)

Sec. 70.1. Authorized video surveillance of common areas. Before video surveillance equipment is installed or operated in the common areas of a State-operated developmental center, the Department must obtain unanimous consent from the residents of that facility or their guardians. If an individual becomes a resident of a facility in which video surveillance equipment has been installed for purposes of monitoring common areas, the Department must obtain consent from the new resident or the resident's guardian before continuing to operate the video surveillance equipment.

Section 10. The Community-Integrated Living Arrangements Licensure and Certification Act is amended by adding Section 14.6 as follows:

Sec. 14.6. Authorized video surveillance of common areas. Before video surveillance equipment is installed or operated in the common areas of a facility licensed under this Act, the owner or operator of that facility must obtain unanimous consent from the residents of that facility or their guardians. If an individual becomes a resident of a facility in which video surveillance equipment has been installed for purposes of monitoring common areas, the owner or operator of that facility must obtain consent from the new resident or resident's guardian before continuing to operate the video surveillance equipment.".
