1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Animal Welfare Act is amended by changing | ||||||
5 | Section 3.3 as follows: | ||||||
6 | (225 ILCS 605/3.3) | ||||||
7 | Sec. 3.3. Adoption of dogs and cats. | ||||||
8 | (a) An animal shelter or animal control facility shall not | ||||||
9 | adopt out any dog or adopt out or return to field any cat | ||||||
10 | unless it has been sterilized and microchipped. However, an | ||||||
11 | animal shelter or animal control facility may adopt out a dog | ||||||
12 | or cat that has not been sterilized and microchipped if the | ||||||
13 | adopting owner has executed a written agreement to have | ||||||
14 | sterilizing and microchipping procedures performed within 14 | ||||||
15 | days after a licensed veterinarian certifies the dog or cat is | ||||||
16 | healthy enough for sterilizing and microchipping procedures | ||||||
17 | and a licensed veterinarian has certified that the dog or cat | ||||||
18 | is too sick or injured to be sterilized or it would be | ||||||
19 | detrimental to the health of the dog or cat to be sterilized or | ||||||
20 | microchipped at the time of the adoption. | ||||||
21 | (b) An animal shelter or animal control facility may adopt | ||||||
22 | out any dog or cat that is not free of disease, injury, or | ||||||
23 | abnormality if the disease, injury, or abnormality is |

1 | disclosed in writing to the adopter, and the animal shelter or | ||||||
2 | animal control facility allows the adopter to return the | ||||||
3 | animal to the animal shelter or animal control facility. | ||||||
4 | (c) The requirements of subsections (a) and (b) of this | ||||||
5 | Section do not apply to adoptions subject to Section 11 of the | ||||||
6 | Animal Control Act. | ||||||
7 | (d) An animal shelter or animal control facility shall | ||||||
8 | waive the adoption fee for a dog or cat if the person adopting | ||||||
9 | the dog or cat: | ||||||
10 | (1) presents to the animal shelter or animal control | ||||||
11 | facility a current and valid Illinois driver's license | ||||||
12 | with the word "veteran" printed on its face, a current and | ||||||
13 | valid Illinois Identification Card with the word "veteran" | ||||||
14 | printed on its face, or a certified copy of the person's | ||||||
15 | Department of Defense form DD-214 (Certificate of Release | ||||||
16 | or Discharge from Active Duty) and a valid Illinois | ||||||
17 | driver's license or valid Illinois Identification Card; | ||||||
18 | and | ||||||
19 | (2) complies with the adoption policies of the animal | ||||||
20 | shelter or animal control facility. | ||||||
21 | (e) An animal shelter or animal control facility may limit | ||||||
22 | the number of dogs or cats adopted from that animal shelter or | ||||||
23 | animal control facility pursuant to this Section to one dog or | ||||||
24 | cat each in a 2-year period.
