AMENDMENT TO HOUSE BILL 2287

2    AMENDMENT NO. ______. Amend House Bill 2287 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 9.19 as follows:
 
6    (415 ILCS 5/9.19 new)
7    Sec. 9.19. Fleet Electrification Incentive Program.
8    (a) In this Section:
9    "Class 6 truck" means a truck or school bus categorized by
10the Federal Highway Administration, using gross vehicle weight
11ratings, as a Class 6 vehicle.
12    "Class 7 truck" means a truck or school bus categorized by
13the Federal Highway Administration, using gross vehicle weight
14ratings, as a Class 7 vehicle.
15    "Class 8 truck" means a truck or school bus categorized by
16the Federal Highway Administration, using gross vehicle weight

1ratings, as a Class 8 vehicle.
2    (b) The Agency shall establish a Fleet Electrification
3Incentive Program to provide fleet owners and operators in
4Illinois grants to promote their use of electric Class 6
5trucks, electric Class 7 trucks, and electric Class 8 trucks.
6The Program shall offer qualifying applicants a grant of up to
7$200,000 per electric Class 6 truck, electric Class 7 truck,
8or electric Class 8 truck purchased or leased for a fleet by
9the fleet's owner or operator.
10    (c) The Agency shall award grants under the Fleet
11Electrification Incentive Program on a competitive basis
12according to the availability of funding. To be eligible to
13receive a grant under the Program an applicant must, at a
14minimum, satisfy all of the following criteria:
15        (1) The electric Class 6 truck, electric Class 7
16    truck, or electric Class 8 truck must be registered in
17    Illinois or recognized under the International
18    Registration Plan.
19        (2) The fleet owner or operator must be domiciled in
20    Illinois.
21        (3) If the electric Class 6 truck, electric Class 7
22    truck, or electric Class 8 truck is leased by the fleet
23    owner or operator, the term of the lease must be at least
24    36 months.
25    In providing grants under the Program, the Agency shall
26give weight to applications based upon the potential impact of

1the geographic locations and routes of the applicant's fleet
2on pollution affecting equity investment eligible communities.
3    In providing grants under the Program, the Agency shall
4give priority to applicants who have negotiated and entered
5into a collective bargaining agreement at the time of
6application for the grant.
7    (d) A grant provided under the Program is limited to a
8maximum award of 80% of the purchase price per vehicle, not to
9exceed $200,000 to purchase or lease one electric Class 6
10truck, electric Class 7 truck, or electric Class 8 truck. A
11fleet owner or operator may be awarded multiple grants under
12the Program, not to exceed 25 grants.
13    (e) A fleet owner or operator who receives a grant under
14this Section must retain title or right of use of the electric
15Class 6 truck, electric Class 7 truck, or electric Class 8
16truck incentivized under the Program for a minimum of 60
17consecutive months after the purchase date or lease date of
18the electric Class 6 truck, electric Class 7 truck, or
19electric Class 8 truck. Resale or sublease of the electric
20Class 6 truck, electric Class 7 truck, or electric Class 8
21truck for financial gain within 60 months after the purchase
22date or lease date is prohibited.
23    (f) The deployment of the electric Class 6 truck, electric
24Class 7 truck, or electric Class 8 truck in the applicant's
25fleet is required within 24 months after receipt of notice of
26approval of the applicant's Program application. Total

1completion of the project for which the electric Class 6
2truck, electric Class 7 truck, or electric Class 8 truck is
3purchased or leased must occur within 36 months after receipt
4of grant funds under the Program.
5    (g) The use of a properly ventilated, conventionally
6powered heater shall not make an electric Class 6 truck,
7electric Class 7 truck, or electric Class 8 truck ineligible
8under this Section.".
