1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Regulatory Sunset Act is amended by
5changing Sections 4.34 and 4.39 as follows:
 
6    (5 ILCS 80/4.34)
7    Sec. 4.34. Acts and Section repealed on January 1, 2024.
8The following Acts and Section of an Act are repealed on
9January 1, 2024:
10        The Crematory Regulation Act.
11        The Electrologist Licensing Act.
12        The Illinois Certified Shorthand Reporters Act of
13    1984.
14        The Illinois Occupational Therapy Practice Act.
15        The Illinois Public Accounting Act.
16        The Private Detective, Private Alarm, Private
17    Security, Fingerprint Vendor, and Locksmith Act of 2004.
18        The Registered Surgical Assistant and Registered
19    Surgical Technologist Title Protection Act.
20        Section 2.5 of the Illinois Plumbing License Law.
21        The Veterinary Medicine and Surgery Practice Act of
22    2004.

2    Sec. 4.39. Acts repealed on January 1, 2029 and December
331, 2029.
4    (a) The following Act is repealed on January 1, 2029:
5        The Environmental Health Practitioner Licensing Act.
6        Section 2.5 of the Illinois Plumbing License Law.
7    (b) The following Act is repealed on December 31, 2029:
8        The Structural Pest Control Act.

11    Section 10. The Landscape Architecture Registration Act is
12amended by changing Section 10 and by adding Section 53 as
13follows:

16    Sec. 10. Definitions. As used in this Act:
17    "Address of record" means the designated address recorded
18by the Department in the applicant's application file or
19registrant's registration file as maintained by the
20Department.
21    "Board" means the Registered Landscape Architecture
22Registration Board.
23    "Department" means the Department of Financial and

1Professional Regulation.
2    "Email address of record" means the designated email
3address of record by the Department in the applicant's
4application file or registrant's registration file as
5maintained by the Department.
6    "Landscape architecture" means the art and science of
7arranging land, together with the spaces and objects upon it,
8for the purpose of creating a safe, efficient, healthful, and
9aesthetically pleasing physical environment for human use and
10enjoyment, as performed by landscape architects.
11    "Landscape architectural practice" means the offering or
12furnishing of professional services in connection with a
13landscape architecture project that do not require the seal of
14an architect, land surveyor, professional engineer, or
15structural engineer. These services may include, but are not
16limited to, providing preliminary studies; developing design
17concepts; planning for the relationships of physical
18improvements and intended uses of the site; establishing form
19and aesthetic elements; developing those technical details on
20the site that are exclusive of any building or structure;
21preparing and coordinating technical submissions; and
22conducting site observation of a landscape architecture
23project.
24    "Registered landscape architect" means a person who, based
25on education, experience, and examination in the field of
26landscape architecture, is registered under this Act.

1    "Secretary" means the Secretary of Financial and
2Professional Regulation. The Secretary may designate his or
3her duties under this Act to a designee of his or her choice,
4including, but not limited to, the Director of Professional
5Regulation.

8    Sec. 53. Continuing education. The Department may adopt
9rules of continuing education for persons registered under
10this Act. The Department shall consider the recommendations of
11the Board in establishing the guidelines for the continuing
12education requirements. The requirements of this Section apply
13to any person seeking renewal or restoration under Section 50.
 
14    Section 99. Effective date. This Section and Section 5
15take effect upon becoming law.
