SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/22.60

    Amends the Environmental Protection Act. Requires permitting and construction to commence prior to July 1, 2027 (rather than 2025) before a pilot project allowing for a pyrolysis or gasification facility is permitted for a locally zoned and approved site in either Will County or Grundy County. Makes a conforming change to language regarding repealing the provisions. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 22.60 as follows:
 
6    (415 ILCS 5/22.60)
7    (For Section repeal see subsection (e))
8    Sec. 22.60. Pilot project for Will County and Grundy
9County pyrolysis or gasification facility.
10    (a) As used in this Section:
11    "Plastics" means polystyrene or any other synthetic
12organic polymer that can be molded into shape under heat and
13pressure and then set into a rigid or slightly elastic form.
14    "Plastics gasification facility" means a manufacturing
15facility that:
16        (1) receives only uncontaminated plastics that have
17    been processed prior to receipt at the facility into a
18    feedstock meeting the facility's specifications for a
19    gasification feedstock; and
20        (2) uses heat in an oxygen-deficient atmosphere to
21    process the feedstock into fuels, chemicals, or chemical
22    feedstocks that are returned to the economic mainstream in
23    the form of raw materials or products.

1    "Plastics pyrolysis facility" means a manufacturing
2facility that:
3        (1) receives only uncontaminated plastics that have
4    been processed prior to receipt at the facility into a
5    feedstock meeting the facility's specifications for a
6    pyrolysis feedstock; and
7        (2) uses heat in the absence of oxygen to process the
8    uncontaminated plastics into fuels, chemicals, or chemical
9    feedstocks that are returned to the economic mainstream in
10    the form of raw materials or products.
11    (b) Provided that permitting and construction has
12commenced prior to July 1, 2027 2025, a pilot project allowing
13for a pyrolysis or gasification facility in accordance with
14this Section is permitted for a locally zoned and approved
15site in either Will County or Grundy County.
16    (c) To the extent allowed by federal law, uncontaminated
17plastics that have been processed into a feedstock meeting
18feedstock specifications for a plastics gasification facility
19or plastics pyrolysis facility, and that are further processed
20by such a facility and returned to the economic mainstream in
21the form of raw materials or products, are considered recycled
22and are not subject to regulation as waste.
23    (d) The Agency may propose to the Board for adoption, and
24the Board may adopt, rules establishing standards for
25materials accepted as feedstocks by plastics gasification
26facilities and plastics pyrolysis facilities, rules

1establishing standards for the management of feedstocks at
2plastics gasification facilities and plastics pyrolysis
3facilities, and any other rules, as may be necessary to
4implement and administer this Section.
5    (e) If permitting and construction for the pilot project
6under subsection (b) has not commenced by July 1, 2027 2025,
7this Section is repealed.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
