SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/3-10020  from Ch. 34, par. 3-10020

    Amends the Counties Code. Repeals a provision which specifies that the office of county treasurer shall become vacant if, in certain circumstances, the county treasurer neglects or refuses to render an account or make settlement at any time when required by law, refuses to answer any question regarding the operation of the county treasurer's office propounded by the county board, or refuses to provide the county board with any requested information concerning the accounts maintained by the county treasurer's office. Provides that the office of county treasurer shall become vacant if the county treasurer dies or resigns or the office otherwise becomes vacant.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing
5Section 3-10020 as follows:
 
6    (55 ILCS 5/3-10020)  (from Ch. 34, par. 3-10020)
7    Sec. 3-10020. Vacancy. Removal for cause; other vacancy.
8If the county treasurer dies or resigns or the office of county
9treasurer become vacant for any other reason, If any county
10treasurer shall neglect or refuse to render an account, or
11make settlement at any time when required by law, or refuse to
12answer any question regarding the operation of the county
13treasurer's office propounded to him by the county board, or
14refuse to provide the county board with any requested
15information concerning the accounts maintained by the county
16treasurer's office, provided the requests are for information
17that the county treasurer is required by law to maintain and in
18a format already maintained by the county treasurer, or is a
19defaulter, and in arrears with the county, or is guilty of any
20other misconduct in his office, the county board may remove
21him from office, and the presiding officer of the county
22board, with the advice and consent of the county board, may
23appoint some suitable person to perform the duties of

1treasurer until his successor is elected, or appointed and
2qualified; or if by reason of the death or resignation of the
3county treasurer, or other cause, the said office shall become
4vacant, then the vacancy shall be filled as provided in the The
5Election Code by appointment of some suitable person to
6perform the duties of treasurer, until a county treasurer is
7elected or appointed and qualified. Provided, that in case any
8county treasurer is called into the active military service of
9the United States, the appointee shall perform and discharge
10all the duties of the county treasurer in such county during
11the time such county treasurer is in the active military
12service of the United States, and such county treasurer so
13appointed shall possess all the powers and discharge all the
14duties of a regularly elected county treasurer under the laws
15of this State, and shall be paid the same compensation as
16provided by law for the county treasurer of the county,
17apportioned as to the time of service, and such appointment
18and all authority thereunder shall cease upon the discharge of
19said county treasurer from such active military service of the
20United States; and provided further, that the office of county
21treasurer shall not be deemed to be vacant during the time the
22said county treasurer is in the active military service of the
23United States. The person so appointed, shall give bond and
24security, as required by law of the county treasurer.
