1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Overdose Prevention and Harm Reduction Act
5is amended by changing Section 10 as follows:
 
6    (410 ILCS 710/10)
7    Sec. 10. Dispensing of drug adulterant testing supplies. A
8pharmacist, physician, advanced practice registered nurse, or
9physician assistant, or the pharmacist's, physician's,
10advanced practice registered nurse's, or physician assistant's
11designee, or a trained overdose responder for an organization
12enrolled in the Drug Overdose Prevention Program administered
13by the Department of Human Services, Division of Substance Use
14Prevention and Recovery may dispense drug adulterant testing
15supplies to any person. Any drug adulterant testing supplies
16to be dispensed under this Section must be stored at a licensed
17pharmacy, hospital, clinic, or other health care facility, or
18at the medical office of a physician, advanced practice
19registered nurse, or physician assistant, or at the premises
20of the organization enrolled in the Drug Overdose Prevention
21Program. Drug adulterant testing supplies shall also be stored
22so that they are accessible only by and in a manner that limits
23access to the drug adulterant testing supplies to pharmacists,

1physicians, advanced practice registered nurses, or physician
2assistants employed at the pharmacy, hospital, clinic, or
3other health care facility or medical office, the designees of
4and any persons designated by the pharmacist, physician,
5advanced practice registered nurse, or physician assistant,
6and trained overdose responders for those organizations
7enrolled in the Drug Overdose Prevention Program administered
8by the Department of Human Services, Division of Substance Use
9Prevention and Recovery. Drug adulterant testing supplies
10dispensed at a retail store containing a pharmacy under this
11Section may be dispensed only from the pharmacy department of
12the retail store. No quantity of drug adulterant testing
13supplies greater than necessary to conduct 5 assays of
14substances suspected of containing adulterants shall be
15dispensed in any single transaction.
