AMENDMENT TO HOUSE BILL 440

2    AMENDMENT NO. ______. Amend House Bill 440 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Insurance Law of the Civil
5Administrative Code of Illinois is amended by adding Section
61405-50 as follows:
 
7    (20 ILCS 1405/1405-50 new)
8    Sec. 1405-50. Consumer Health Care Access Liaison. The
9Governor, with the advice and consent of the Senate, shall
10appoint a person within the Department of Insurance to serve
11as the Consumer Health Care Access Liaison for the State of
12Illinois. The Consumer Health Care Access Liaison shall
13receive an annual salary as set by the Governor and beginning
14July 1, 2023 shall be compensated from appropriations made for
15this purpose. The person appointed to serve as Consumer Health
16Care Access Liaison may be an existing employee with other

1duties. The Consumer Health Care Access Liaison shall have
2authority to oversee and direct functions at other State
3agencies related to network adequacy issues in Illinois,
4including, but not limited to, the Department of Public
5Health, the Department of Financial and Professional
6Regulation, and the Department of Healthcare and Family
7Services.
 
8    Section 10. The Network Adequacy and Transparency Act is
9amended by changing Section 30 as follows:
 
10    (215 ILCS 124/30)
11    Sec. 30. Administration and enforcement.
12    (a) Insurers, as defined in this Act, have a continuing
13obligation to comply with the requirements of this Act. Other
14than the duties specifically created in this Act, nothing in
15this Act is intended to preclude, prevent, or require the
16adoption, modification, or termination of any utilization
17management, quality management, or claims processing
18methodologies of an insurer.
19    (b) Nothing in this Act precludes, prevents, or requires
20the adoption, modification, or termination of any network plan
21term, benefit, coverage or eligibility provision, or payment
22methodology.
23    (c) The Director shall enforce the provisions of this Act
24pursuant to the enforcement powers granted to it by law.

1    (d) The Department shall adopt rules to enforce compliance
2with this Act to the extent necessary.
3    (e) The Consumer Health Care Access Liaison shall enforce
4the provisions of this Act pursuant to Section 1405-50 of the
5Department of Insurance Law.
