SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Health Care Services Human Trafficking Recognition Training Act. Provides that beginning June 1, 2023, any health care practitioner licensed to practice in the State shall undergo training in the recognition of human trafficking and protocols for reporting observed human trafficking to the appropriate authority. Provides that the Department of Financial and Professional Regulation shall develop a curriculum for an approved human trafficking training recognition program that shall be made publicly available at no cost on its website. Provides that the Department shall develop and publish the human trafficking recognition training program no later than June 1, 2023.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Health
5Care Services Human Trafficking Recognition Training Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Department" means the Department of Financial and
8Professional Regulation.
9    "Health care practitioner" means any health care
10practitioner, including a physician, dentist, podiatric
11physician, advanced practice registered nurse, registered
12nurse, licensed practical nurse, physician assistant, clinical
13psychologist, clinical social worker, therapist, or counselor.
14"Health care practitioner" includes a medical office, health
15care clinic, health department, group practice, and any other
16organizational structure for a licensed professional to
17provide health care services. "Health care practitioner" does
18not include a health care facility.
19    "Human trafficking" means the deprivation or violation of
20the personal liberty of another with the intent to obtain
21forced labor or services, procure or sell the individual for
22commercial sex, or exploit the individual in obscene matter.
23Depriving or violating a person's liberty includes substantial

1and sustained restriction of another's liberty accomplished
2through fraud, deceit, coercion, violence, duress, menace, or
3threat of unlawful injury to the victim or to another person,
4under circumstances where the person receiving or apprehending
5the threat reasonably believes that it is likely that the
6person making the threat would carry it out.
 
7    Section 10. Human trafficking recognition training.
8Beginning June 1, 2023, any health care practitioner licensed
9to practice in this State shall undergo training in the
10recognition of human trafficking and protocols for reporting
11observed human trafficking to the appropriate authority. The
12health care practitioner must complete the training within 6
13months after beginning employment in this State and every 2
14years thereafter. The training shall be at least 20 minutes in
15duration.
 
16    Section 15. Human trafficking recognition training
17curriculum.
18    (a) A human trafficking training program in compliance
19with this Act shall include, at a minimum, all of the
20following:
21        (1) a definition of human trafficking and commercial
22    exploitation of children;
23        (2) guidance on how to identify individuals who are
24    most at risk for human trafficking;

1        (3) the difference between human trafficking for
2    purposes of labor and for purposes of sex as the
3    trafficking relates to lodging establishments; and
4        (4) guidance on the role of health care service
5    employees in reporting and responding to instances of
6    human trafficking.
7    (b) The Department shall develop a curriculum for an
8approved human trafficking training recognition program that
9shall be made publicly available at no cost on its website. The
10Department may consult the United States Department of Justice
11for the human trafficking recognition training program
12developed under this subsection. The Department shall develop
13and publish the human trafficking recognition training program
14described in this subsection no later than June 1, 2023.
