AMENDMENT TO SENATE BILL 2339

2    AMENDMENT NO. ______. Amend Senate Bill 2339 on page 1, by
3replacing line 16, with the following: "defendant, or
4defendant's attorney, advocate, or victim's attorney (as
5defined in Section 3 of the Illinois Rights of Crime Victims
6and Witnesses Act) in any criminal proceeding"; and
 
7on page 2, immediately below line 2, by inserting:
8    "A court may prohibit such disclosure only after giving
9notice and a hearing to all affected parties. In determining
10whether to prohibit disclosure of the minor's identity the
11court shall consider:
12        (1) the best interest of the child; and
13        (2) whether such nondisclosure would further a
14    compelling State interest."; and
 
15on page 2, by replacing line 15 through line 24 with the
16following:

1"The copy of the criminal history record information to be
2provided under this Section shall exclude the identity of the
3child victim. The superintendent shall be restricted from
4specifically revealing the identity name of the victim without
5written consent of the victim or victim's parent or guardian.
6Nothing in this Article precludes or may be used to preclude a
7mandated reporter from reporting child abuse or child neglect
8as required under the Abused and Neglected Child Reporting
9Act.
10    A court may prohibit such disclosure only after giving
11notice and a hearing to all affected parties. In determining
12whether to prohibit disclosure of the minor's identity the
13court shall consider:
14        (a) the best interest of the child; and
15        (b) whether such nondisclosure would further a
16    compelling State interest.".
