SYNOPSIS AS INTRODUCED:
 
230 ILCS 5/31.1  from Ch. 8, par. 37-31.1

    Amends the Illinois Horse Racing Act of 1975. In provisions requiring an organization licensee to contribute to charity, provides that the contributions shall be made to community centers awarded grants under the Community Health Center Expansion Act (rather than non-profit organizations) that provide certain services to persons who reside or work on the backstretch of Illinois racetracks. Adds dental and behavioral health services to the services required to be provided.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Horse Racing Act of 1975 is
5amended by changing Section 31.1 as follows:
 
6    (230 ILCS 5/31.1)  (from Ch. 8, par. 37-31.1)
7    Sec. 31.1. (a) Unless subsection (a-5) applies,
8organization licensees collectively shall contribute annually
9to charity the sum of $750,000 to non-profit organizations
10that provide medical and family, counseling, and similar
11services to persons who reside or work on the backstretch of
12Illinois racetracks. Unless subsection (a-5) applies, these
13contributions shall be collected as follows: (i) no later than
14July 1st of each year the Board shall assess each organization
15licensee, except those tracks located in Madison County, which
16tracks shall pay $30,000 annually apiece into the Board
17charity fund, that amount which equals $690,000 multiplied by
18the amount of pari-mutuel wagering handled by the organization
19licensee in the year preceding assessment and divided by the
20total pari-mutuel wagering handled by all Illinois
21organization licensees, except those tracks located in Madison
22and Rock Island counties, in the year preceding assessment;
23(ii) notice of the assessed contribution shall be mailed to

1each organization licensee; (iii) within thirty days of its
2receipt of such notice, each organization licensee shall remit
3the assessed contribution to the Board. Unless subsection
4(a-5) applies, if an organization licensee commences operation
5of gaming at its facility pursuant to an organization gaming
6license under the Illinois Gambling Act, then the organization
7licensee shall contribute an additional $83,000 per year
8beginning in the year subsequent to the first year in which the
9organization licensee begins receiving funds from gaming
10pursuant to an organization gaming license. If an organization
11licensee wilfully fails to so remit the contribution, the
12Board may revoke its license to conduct horse racing.
13    (a-5) If (1) an organization licensee that did not operate
14live racing in 2017 is awarded racing dates in 2018 or in any
15subsequent year and (2) all organization licensees are
16operating gaming pursuant to an organization gaming license
17under the Illinois Gambling Act, then subsection (a) does not
18apply and organization licensees collectively shall contribute
19annually to charity the sum of $1,000,000 to community centers
20awarded grants under the Community Health Center Expansion Act
21non-profit organizations that provide medical, dental,
22behavioral health, and family, counseling, and similar
23services to persons who reside or work on the backstretch of
24Illinois racetracks. These contributions shall be collected as
25follows: (i) no later than July 1st of each year the Board
26shall assess each organization licensee an amount based on the

1proportionate amount of live racing days in the calendar year
2for which the Board has awarded to the organization licensee
3out of the total aggregate number of live racing days awarded;
4(ii) notice of the assessed contribution shall be mailed to
5each organization licensee; (iii) within 30 days after its
6receipt of such notice, each organization licensee shall remit
7the assessed contribution to the Board. If an organization
8licensee willfully fails to so remit the contribution, the
9Board may revoke its license to conduct horse racing.
10    (b) No later than October 1st of each year, any qualified
11charitable organization seeking an allotment of contributed
12funds shall submit to the Board an application for those
13funds, using the Board's approved form. No later than December
1431st of each year, the Board shall distribute all such amounts
15collected that year to such charitable organization
16applicants.
