SYNOPSIS AS INTRODUCED:

    Amends the School Code. Provides that each board of school directors shall appoint one nonvoting member who is a teacher employed by the school district under the jurisdiction of the board. Provides that the teacher member shall have the privilege of casting advisory votes and shall have all of the privileges of membership, including the right to make and second motions and to attend executive sessions, other than the right to vote. Amends the Public Community College Act. Provides that each board of trustees shall have one nonvoting member who is a faculty member employed by the community college district under the jurisdiction of the board. Provides that the faculty member shall have the privilege of casting advisory votes and shall have all of the privileges of membership, including the right to make and second motions and to attend executive sessions, other than the right to vote. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
510-1 as follows:
 
6    (105 ILCS 5/10-1)  (from Ch. 122, par. 10-1)
7    Sec. 10-1. Board of school directors.
8    (a) School districts having a population of fewer than
91000 inhabitants and not governed by any special act shall be
10governed by a board of school directors to consist of 3 members
11who shall be elected in the manner provided in Article 9 of
12this Act. In consolidated districts and in districts in which
13the membership of the board of school directors is increased
14as provided in subsection (b), 7 members shall be so elected.
15    (b) Upon presentment to the board of school directors of a
16school district having a population of fewer than 1,000
17inhabitants of a petition signed by the lesser of 5% or 25 of
18the registered voters of the district to increase the
19membership of the district's board of school directors to 7
20directors and to elect a new 7-member board of school
21directors to replace the district's existing board of 3 school
22directors, the clerk or secretary of the board of school
23directors shall certify the proposition to the proper election

1authorities for submission to the electors of the district at
2a regular scheduled election in accordance with the general
3election law. If the proposition is approved by a majority of
4those voting on the proposition, the members of the board of
5school directors of that district thereafter shall be elected
6in the manner provided by subsection (c) of Section 10-4.
7    (c) A board of school directors may appoint a student to
8the board to serve in an advisory capacity. The student member
9shall serve for a term as determined by the board. The board
10may not grant the student member any voting privileges, but
11shall consider the student member as an advisor. The student
12member may not participate in or attend any executive session
13of the board.
14    (d) Each board of school directors shall appoint one
15nonvoting member who is a teacher employed by the school
16district under the jurisdiction of the board. If the district
17has multiple school buildings, the teacher member shall be
18selected to represent all school buildings in the district. In
19a multi-building district, the building from which the teacher
20member is selected shall be determined by lot each year,
21provided that no building shall twice have selected a teacher
22member until all buildings in the district have been
23represented on the board by a teacher member once. The same
24procedure shall be followed until all buildings have been
25represented a second time, a third time, and subsequent times.

1by building-wide teacher referendum.
2    The teacher member shall serve a term of 4 years beginning
3on April 15 of each year, except that the teacher member
4initially selected shall serve a term beginning on the date of
5selection and expiring on the next succeeding June 30.
6    The teacher member shall have the privilege of casting
7advisory votes. The teacher member shall have all of the
8privileges of membership, including the right to make and
9second motions and to attend executive sessions, other than
10the right to vote.

12    Section 10. The Public Community College Act is amended by
13changing Section 3-7.24 as follows:

15    Sec. 3-7.24. Nonvoting board members.
16    (a) Each community college board shall have one non-voting
17member who is a student enrolled in the community college
18under the jurisdiction of the board. One non-voting student
19member shall also be selected in multi-campus districts to
20represent all campuses in those districts. In multi-campus
21districts, the campus from which the member is selected shall
22be determined by lot each year provided that no campus shall
23twice have selected a non-voting student member until all
24campuses in the district have once been represented on the

1district board. The same procedure shall be followed until all
2campuses have been represented a second time, a third time,
3and subsequent times. The method of selecting these student
4members shall be determined by campus-wide student referendum.
5    The student members shall serve a term of one year
6beginning on April 15 of each year, except that the student
7member initially selected shall serve a term beginning on the
8date of selection and expiring on the next succeeding June 30.
9    The nonvoting student members shall have all of the
10privileges of membership, including the right to make and
11second motions and to attend executive sessions, other than
12the right to vote.
13    (b) Each board shall have one nonvoting member who is a
14faculty member employed by the community college district
15under the jurisdiction of the board. If the district has
16multiple campuses, the faculty member shall be selected to
17represent all campuses in the district. In a multi-campus
18district, the campus from which the member is selected shall
19be determined by lot each year, provided that no campus shall
20twice have selected a faculty member until all campuses in the
21district have been represented on the board by a faculty
22member once. The same procedure shall be followed until all
23campuses have been represented a second time, a third time,
24and subsequent times. The method of selecting the faculty
25member shall be determined by campus-wide faculty member
26referendum. Contingent or adjunct faculty may be considered

1along with full-time faculty without regard to part-time
2status.
3    The faculty member shall serve a term of 4 years beginning
4on April 15 of each year, except that the faculty member
5initially selected shall serve a term beginning on the date of

8advisory votes. The faculty member shall have all of the
9privileges of membership, including the right to make and
10second motions and to attend executive sessions, other than
11the right to vote.

13    Section 99. Effective date. This Act takes effect upon
