SYNOPSIS AS INTRODUCED:

    Amends the State Employees Group Insurance Act of 1971. Provides that on or after January 1, 2022, any new mandated health insurance coverage of services or payment for specified providers enacted by the General Assembly shall apply only to the benefits provided under the Act. Provides that on or before March 1 of each year, after a one-year period for which the new mandate has been applied, the Department of Central Management Services shall submit a cost-benefit analysis report to the General Assembly. Provides that the report shall include the impact the mandated coverage has had on the state employee group health insurance program, data on costs of such mandated coverage and utilization, and a recommendation as to whether the mandated coverage should continue for the state employee group health insurance program or whether additional utilization and cost data is required. Amends the Department of Insurance Law of the Civil Administrative Code of Illinois. Provides that the Director of Insurance shall not take action or enforce compliance with an act of the General Assembly mandating health insurance coverage for services or payment for specified providers that applies the mandate to any individual or group policy of accident and health insurance unless specified conditions are met. Amends the Illinois Insurance Code to make conforming changes.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Employees Group Insurance Act of 1971
5is amended by adding Section 6.17 as follows:
 
6    (5 ILCS 375/6.17 new)
7    Sec. 6.17. Mandated health benefits; cost-benefit
8analysis. Notwithstanding any other provision of law, on or
9after January 1, 2022, any new mandated health insurance
10coverage of services or payment for specified providers
11enacted by the General Assembly shall apply only to the
12benefits provided under this Act. On or before March 1 of each
13year, after a one-year period for which the new mandate has
14been applied under this Act, the Department of Central
15Management Services shall submit to the General Assembly a
16cost-benefit analysis report indicating the impact the
17mandated coverage has had on the program of health benefits
18under this Act, including data on the costs of such mandated
19coverage and utilization. The report shall also include a
20recommendation as to whether the mandated coverage should
21continue for the program of health benefits under this Act and
22whether additional utilization and cost data is required.

1    Section 10. The Department of Insurance Law of the Civil
2Administrative Code of Illinois is amended by adding Section
31405-40 as follows:
 
4    (20 ILCS 1405/1405-40 new)
5    Sec. 1405-40. Mandated health benefits; limitation on
6enforcement. The Director of Insurance shall not take action
7or enforce compliance with an act of the General Assembly
8mandating health insurance coverage for services or payment
9for specified providers that applies the mandate to any
10individual or group policy of accident and health insurance in
11accordance with the Illinois Insurance Code unless the
12following conditions are met:
13        (1) the Department of Central Management Services has
14    recommended continuation of the mandated coverage for the
15    program of health benefits under the State Employees Group
16    Insurance Act of 1971;
17        (2) a cost-benefit analysis report for the mandate has
18    been prepared by the Department of Central Management
19    Services; and
20        (3) the mandate has been introduced as a new bill or
21    amendment subject to the necessary approval by the General
22    Assembly.
 
23    Section 15. The Illinois Insurance Code is amended by
24adding Section 356z.43 as follows:

1    (215 ILCS 5/356z.43 new)
2    Sec. 356z.43. Mandated health benefits. Notwithstanding
3any other provision of law, on or after January 1, 2022, any
4new mandated health insurance coverage of services or payments
5for specified providers enacted by the General Assembly shall
6not apply to any individual or group policy of accident and
7health insurance, except for those available under the State
8Employees Group Insurance Act of 1971, unless the conditions
9specified in Section 1405-40 of the Department of Insurance
10Law of the Civil Administrative Code of Illinois have been
11met.
