SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/1A-3  from Ch. 46, par. 1A-3

    Amends the Election Code. In provisions requiring the Governor to appoint 2 members to the State Board of Elections from a list of nominees submitted by certain State executive officers from the opposing political party as the Governor, provides that when all State executive officers are affiliated with the same political party as the Governor, the highest ranking State Senator of the political party not affiliated with the Governor shall be considered the nominating State officer to submit the list of nominees (rather than all members to be appointed to the Board that year from both designated political parties shall be appointed by the Governor without nomination).

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Section 1A-3 as follows:
 
6    (10 ILCS 5/1A-3)  (from Ch. 46, par. 1A-3)
7    Sec. 1A-3. Subject to the confirmation requirements of
8Section 1A-4, 4 members of the State Board of Elections shall
9be appointed in each odd-numbered year as follows:
10        (1) The Governor shall appoint 2 members of the same
11    political party with which he is affiliated, one from each
12    area of required residence.
13        (2) The Governor shall appoint 2 members of the
14    political party whose candidate for Governor in the most
15    recent general election received the second highest number
16    of votes, one from each area of required residence, from a
17    list of nominees submitted by the first state executive
18    officer in the order indicated herein affiliated with such
19    political party: Attorney General, Secretary of State,
20    Comptroller, and Treasurer. If none of the State executive
21    officers listed herein is affiliated with such political
22    party, the nominating State officer shall be the first
23    State executive officer in the order indicated herein

1    affiliated with an established political party other than
2    that of the Governor.
3        (3) The nominating state officer shall submit in
4    writing to the Governor 3 names of qualified persons for
5    each membership on the State Board of Elections Election
6    to be appointed from the political party of that officer.
7    The Governor may reject any or all of the nominees on any
8    such list and may request an additional list. The second
9    list shall be submitted by the nominating officer and
10    shall contain 3 new names of qualified persons for each
11    remaining appointment, except that if the Governor
12    expressly reserves any nominee's name from the first list,
13    that nominee shall not be replaced on the second list. The
14    second list shall be final.
15        (4) Whenever all the state executive officers
16    designated in paragraph (2) are affiliated with the same
17    political party as that of the Governor, the highest
18    ranking State Senator of the political party not
19    affiliated with the Governor shall be considered the
20    nominating State officer designated in paragraph (3). ,
21    all 4 members of the Board to be appointed that year, from
22    both designated political parties, shall be appointed by
23    the Governor without nominations.
24        (5) The Governor shall submit in writing to the
25    President of the Senate the name of each person appointed
26    to the State Board of Elections, and shall designate the

1    term for which the appointment is made and the name of the
2    member whom the appointee is to succeed.
3        (6) The appointments shall be made and submitted by
4    the Governor no later than April 1 and a nominating state
5    officer required to submit a list of nominees to the
6    Governor pursuant to paragraph (3) shall submit a list no
7    later than March 1. For appointments occurring in 2019,
8    the appointments shall be made and submitted by the
9    Governor no later than May 15.
10        (7) In the appointment of the initial members of the
11    Board pursuant to this amendatory Act of 1978, the
12    provisions of paragraphs (1), (2), (3), (5), and (6) of
13    this Section shall apply except that the Governor shall
14    appoint all 8 members, 2 from each of the designated
15    political parties from each area of required residence.
