AMENDMENT TO SENATE BILL 1673

2    AMENDMENT NO. ______. Amend Senate Bill 1673 on page 1,
3line 4, after "by", by inserting "changing Sections 2.11c,
43.5, and 9, and by"; and
 
5on page 1, by inserting immediately below line 5 the
6following:
 
7    "(510 ILCS 5/2.11c)
8    Sec. 2.11c. Intact animal. "Intact animal" means an animal
9that has not been sterilized spayed or neutered.

12    Sec. 3.5. County animal population fund use limitation.
13Funds placed in the county animal population control fund may
14only be used to (1) spay, neuter, vaccinate, or sterilize
15adopted dogs or cats; (2) sterilize spay, neuter, or vaccinate

1dogs or cats owned by low income county residents who are
2eligible for the Food Stamp Program or Social Security
3Disability Benefits Program; or (3) sterilize spay, neuter,
4and vaccinate feral cats in programs recognized by the county
5or a municipality. This Section does not apply to a county with
63,000,000 or more inhabitants.

9on page 1, by replacing line 7 through line 12 with the
10following:
11    "Sec. 3.6. Feral cat jurisdiction and sterilization. The
12Department and no other State agency has any jurisdiction over
13feral cats, except that the Department of Natural Resources
14has jurisdiction over cats in State Parks."; and
 
15on page 1, by inserting below line 12 the following:
 
16    "(510 ILCS 5/9)  (from Ch. 8, par. 359)
17    Sec. 9. Any dog found running at large contrary to
18provisions of this Act may be apprehended and impounded. For
19this purpose, the Administrator shall utilize any existing or
20available animal control facility or licensed animal shelter.
21The dog's owner shall pay a $25 public safety fine to be
22deposited into the county animal control fund or the county
23pet population control fund. Funds transferred to or retained

1by a municipality before the effective date of this amendatory
2Act of the 100th General Assembly under this paragraph shall
3continue to be transferred to and be retained by that
4municipality. A dog found running at large contrary to the
5provisions of this Act a second or subsequent time must be
6sterilized spayed or neutered within 30 days after being
7reclaimed unless already sterilized spayed or neutered;
8failure to comply shall result in impoundment.
9    A dog that is actively engaged in a legal hunting
10activity, including training, is not considered to be running
11at large if the dog is on land that is open to hunting or on
12land on which the person has obtained permission to hunt or to
13train a dog. A dog that is in a dog-friendly area or dog park
14is not considered to be running at large if the dog is
15monitored or supervised by a person.
