AMENDMENT TO SENATE BILL 1672

2    AMENDMENT NO. ______. Amend Senate Bill 1672, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Insurance Code is amended by
6adding Section 143.10d as follows:
 
7    (215 ILCS 5/143.10d new)
8    Sec. 143.10d. Claim information for a dog-related
9incident.
10    (a) An insurance company offering homeowner's insurance
11coverage or renter's insurance coverage that issues a policy
12or contract insuring against liability for injury to a person
13or injury to or destruction of property arising out of the
14ownership, lease, or rental of residential property shall, to
15the best of their ability, for any claim involving a
16dog-related incident, record circumstances relating to the

1incident, including, but not limited to:
2        (1) the breed of dog, and, if the breed was made by
3    visual identification, who made the identification: the
4    adjuster, the owner, or the insured;
5        (2) where the owner or insured obtained the dog from:
6    a pet store, a breeder, an animal shelter or rescue, a
7    friend or acquaintance, or found the dog as a stray;
8        (3) the sex of the dog and whether the dog was spayed
9    or neutered;
10        (4) whether the person injured by the dog was observed
11    engaging in teasing, tormenting, battering, assaulting,
12    injuring, or otherwise provoking the dog;
13        (5) the type of injury sustained by the victim, such
14    as a bite or fall;
15        (6) whether the incident occurred on the insured's
16    property or another location; and
17        (7) any obedience training or previous claims or past
18    complaints against the dog.
19    (b) This information shall be collected for a 2-year
20period beginning on January 1, 2022 and shall be reported
21annually to the Department. The Department shall make the
22information available on the Department's website by July 1,
232023 and shall update the information each July 1 through July
241, 2024. The information or data collected by the Department
25shall not be released or published in any way that violates the
26confidentiality or proprietary status or nature of the data.".
