AMENDMENT TO SENATE BILL 1079

2    AMENDMENT NO. ______. Amend Senate Bill 1079 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6changing Section 2105-15.5 as follows:
 
7    (20 ILCS 2105/2105-15.5)
8    Sec. 2105-15.5. Continuing education; sexual harassment
9prevention training.
10    (a) The Department shall require each licensee to complete
11sexual harassment prevention training provided by the
12licensee's employer, the Department of Human Rights, or any
13continuing education provider authorized to provide continuing
14education under an Act administered by the Department in
15accordance with Section 2-109 of the Illinois Human Rights
16Act. The training shall be completed, at a minimum, prior to a

1licensee's renewal of his or her license. The Department shall
2not refuse to renew a license if a license does not complete
3the training requirements in this subsection (a). As used in
4this Section, "sexual harassment" means any unwelcome sexual
5advances or requests for sexual favors or any conduct of a
6sexual nature when: (i) submission to such conduct is made
7either explicitly or implicitly a term or condition of an
8individual's employment; (ii) submission to or rejection of
9such conduct by an individual is used as the basis for
10employment decisions affecting such individual; or (iii) such
11conduct has the purpose or effect of substantially interfering
12with an individual's work performance or creating an
13intimidating, hostile, or offensive working environment. For
14the purpose of this definition, "working environment" is not
15limited to a physical location that an employee is assigned to
16perform his or her duties and does not require an employment
17relationship.
18    (b) For license renewals occurring on or after January 1,
192020 for a profession that has continuing education
20requirements, the required continuing education hours shall
21include at least one hour of sexual harassment prevention
22training.
23    (b) (c) The Department may adopt rules for the
24implementation of this Section.
