AMENDMENT TO SENATE BILL 633

2    AMENDMENT NO. ______. Amend Senate Bill 633 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of State Police Law of the
5Civil Administrative Code of Illinois is amended by adding
6Section 2605-615 as follows:
 
7    (20 ILCS 2605/2605-615 new)
8    Sec. 2605-615. Sexual assault data. The Illinois State
9Police shall post on its website for each school year the total
10number of sexual assault incidents reported by school
11districts statewide and in each school district under Sections
1210-20.75 and 34-18.67 of the School Code. The Illinois State
13Police shall also report the data annually to the General
14Assembly no later than September 1 of each year.
 
15    Section 10. The School Code is amended by adding Sections

12-3.182, 10-20.75, and 34-18.67 as follows:
 
2    (105 ILCS 5/2-3.182 new)
3    Sec. 2-3.182. Sexual assault data. The State Board of
4Education shall provide a link on its website to the website of
5the Illinois State Police where the sexual assault data
6reported under Sections 10-20.75 and 34-18.67 of this Code may
7be accessed by the public.
 
8    (105 ILCS 5/10-20.75 new)
9    Sec. 10-20.75. Attacks on students; sexual assault.
10    (a) In this Section, "sexual assault" means any act of
11nonconsensual sexual conduct or sexual penetration, as defined
12under Section 11-0.1 of the Criminal Code of 2012, including,
13but not limited to, acts prohibited under Sections 11-1.20
14through 11-1.60 of the Criminal Code of 2012.
15    (b) Upon knowledge of an incident of sexual assault by a
16student against another student, a school district shall
17report the incident to the State Board of Education and the
18Illinois State Police.
 
19    (105 ILCS 5/34-18.67 new)
20    Sec. 34-18.67. Attacks on students; sexual assault.
21    (a) In this Section, "sexual assault" means any act of
22nonconsensual sexual conduct or sexual penetration, as defined
23under Section 11-0.1 of the Criminal Code of 2012, including,
