AMENDMENT TO SENATE BILL 101

2    AMENDMENT NO. ______. Amend Senate Bill 101 immediately
3above the enacting clause by inserting the following:
 
4    "WHEREAS, Postsecondary education is increasingly
5necessary for success in the modern workforce; and
 
6    WHEREAS, The affordability of college is an ongoing
7concern for students, families, and State policymakers; and
 
8    WHEREAS, The equitable first-day-of-class access to
9effective textbooks and other learning materials plays a
10critical role in a student's postsecondary educational
11experience; and
 
12    WHEREAS, Institutions of higher learning within and
13outside of this State are utilizing online educational
14software to enhance and personalize a student's learning

1experience while driving down the costs of attending college;
2therefore,"; and
 
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the
6College Course Materials Affordability and Equitable Access
7Collaborative Study Act.
 
8    Section 5. College Course Materials Affordability and
9Equitable Access Task Force; membership.
10    (a) The College Course Materials Affordability and
11Equitable Access Task Force is created within the Illinois
12Student Assistance Commission.
13    (b) The Task Force shall consist of all of the following
14members:
15        (1) One member of the General Assembly appointed by
16    the President of the Senate.
17        (2) One member of the General Assembly appointed by
18    the Minority Leader of the Senate.
19        (3) One member of the General Assembly appointed by
20    the Speaker of the House of Representatives.
21        (4) One member of the General Assembly appointed by
22    the Minority Leader of the House of Representatives.
23        (5) One member of the public appointed by the

1    President of the Senate.
2        (6) One member of the public appointed by the Minority
3    Leader of the Senate.
4        (7) One member of the public appointed by the Speaker
5    of the House of Representatives.
6        (8) One member of the public appointed by the Minority
7    Leader of the House of Representatives.
8        (9) One member representing an institution of higher
9    learning appointed by the President of the Senate.
10        (10) One member representing an institution of higher
11    learning appointed by the Minority Leader of the Senate.
12        (11) One member representing an institution of higher
13    learning appointed by the Speaker of the House of
14    Representatives.
15        (12) One member representing an institution of higher
16    learning appointed by the Minority Leader of the House of
17    Representatives.
18        (13) The following members appointed by the Governor:
19            (A) One member representing the Board of Higher
20        Education.
21            (B) One member representing the Illinois Community
22        College Board.
23            (C) One member representing the Illinois Student
24        Assistance Commission.
25            (D) One member representing the Faculty Advisory
26        Council of the Board of Higher Education.

1            (E) One member representing the Student Advisory
2        Council of the Board of Higher Education.
3            (F) One member who is a librarian or online
4        education specialist.
5            (G) One member representing a national association
6        representing the higher education textbook publishing
7        industry.
8            (H) One member representing a statewide
9        professional organization that advocates on behalf of
10        public university employees.
11            (I) One member representing a statewide
12        professional organization that advocates on behalf of
13        public community college employees.
14            (J) One member representing a national association
15        representing higher education book stores in this
16        State.
17            (K) One member representing a higher education
18        digital content platform provider with offices located
19        within this State.
20    (b) Appointments to the Task Force shall be made within 90
21days after the effective date of this Act.
22    (c) The Task Force shall meet initially at the call of the
23Illinois Student Assistance Commission, shall elect a
24chairperson from among the appointed members at the Task
25Force's initial meeting, and shall thereafter meet at the call
26of the chairperson.

1    (d) The chairperson and other members of the Task Force
2shall serve without compensation but shall be reimbursed for
3their reasonable and necessary expenses from funds
4appropriated to the Illinois Student Assistance Commission for
5that purpose, including travel, subject to the rules of the
6appropriate travel control board.
 
7    Section 10. Illinois Student Assistance Commission
8assistance.
9    (a) The Illinois Student Assistance Commission shall
10provide administrative support, staff support, and other
11resources necessary for the College Course Materials
12Affordability and Equitable Access Task Force to fulfill the
13Task Force's obligations under this Act.
14    (b) The Illinois Student Assistance Commission shall
15designate a staff member to serve as a point of contact between
16the Task Force and the public and to serve as a technology and
17policy advisor to assist the Task Force. The Commission shall
18provide a public website or web page for the Task Force to
19publish digital meeting notices, minutes, commentary, draft
20reports, reports, and other relevant documents and information
21online.
 
22    Section 15. Meetings.
23    (a) Meetings of the College Course Materials Affordability
24and Equitable Access Task Force are subject to the Open

1Meetings Act. The Task Force shall make available to the
2public online meeting notices at least 10 days in advance of
3any Task Force meeting and shall publish meeting minutes that
4are available to the public within 14 days after the meeting to
5allow for structured written and verbal commentary by the
6public throughout the process.
7    (b) The Task Force shall establish and maintain a contact
8list of all members of the public who seek to be apprised of
9the work of the Task Force to allow for electronic
10notification, by email or by any other mutually agreed-upon
11method, of Task Force meetings, agendas, minutes, draft
12reports, reports, and other communications regarding the work
13of the Task Force.
14    (c) The Task Force may conduct its work remotely via
15telephone and online video broadcasting, including through
16audio and video conferencing applications. The Task Force
17shall allow for public observation and structured
18participation via telephone and online video broadcasting for
19all meetings conducted by the Task Force.
 
20    Section 20. Duties.
21    (a) The duties of the College Course Materials
22Affordability and Equitable Access Task Force are to:
23        (1) conduct a collaborative college course materials
24    affordability and equitable access study;
25        (2) examine the cost-saving methods and practices

1    utilized by public and private institutions of higher
2    learning in this State and throughout the United States
3    for improving students' equitable first-day-of-class
4    access to required course materials and conduct an
5    affordability comparison of providing students' course
6    materials, including digital learning tools; and
7        (3) submit a report of its findings to the Governor,
8    the General Assembly, and the Illinois Student Assistance
9    Commission.
10    (b) The report required to be submitted under subsection
11(a) shall include all of the following items:
12        (1) A list of cost-saving methods available to
13    students, including, but not limited to:
14            (A) inclusive access programs;
15            (B) textbook subscription programs;
16            (C) textbook rental programs;
17            (D) used textbooks; and
18            (E) other institutional textbook cost-saving
19            methods, such as open educational resources.
20        (2) The total amount of cost savings achieved by
21    public and private institutions of higher learning and the
22    total number of students that utilize each cost-saving
23    method.
24        (3) The equitable access achieved for students by
25    providing all students with access to course materials on
26    the first day of class.

1        (4) The potential impact on academic freedom of
2    faculty to be able to choose the most appropriate
3    materials for their courses for each of the various
4    methods of providing course materials.
5        (5) A description of the process required to implement
6    each cost-saving method listed in paragraph (1) of this
7    subsection (b).
8        (6) A description of the process by which students
9    obtain required course materials.
10        (7) The current, future, and potential costs of the
11    development and maintenance necessary for the utilization
12    of any course material that is provided to students at no
13    charge.
14        (8) The identification of best practices resulting
15    from the cost-saving methods listed in paragraph (1) of
16    this subsection (b).
17        (9) An examination of the following areas in relation
18    to improving equity in higher education to determine
19    whether the methods:
20            (A) improved equitable access to required course
21        materials by the first day of class;
22            (B) increased the affordability of required course
23        materials; and
24            (C) improved access to learning materials and
25        improved student outcomes for minority, low-income,
26        and first-generation students.

1        (10) A description of the ways students and faculty
2    are utilizing or have utilized inclusive access programs,
3    subscription programs, textbook rental programs, used
4    textbooks, and open educational resources for the purposes
5    of remote learning as a result of the COVID-19 pandemic
6    health crisis.
 
7    Section 25. Collaboration. As part of the College Course
8Materials Affordability and Equitable Access Task Force's
9information gathering process to prepare its report under
10Section 20, the Task Force shall engage and consult with
11higher education administrators, faculty, campus bookstores,
12publishers, librarians, and other online education specialists
13for their perspectives on the topics covered by this Act. The
14Task Force may also seek advice and input from such other
15persons and entities as the Task Force finds helpful to its
16work as outlined in this Act.
 
17    Section 30. Reporting; dissolution.
18    (a) No later than October 1, 2022, the Task Force shall
19submit an initial collaborative report of its findings to the
20Governor, the General Assembly, and the Illinois Student
21Assistance Commission. The Illinois Student Assistance
22Commission shall publish the initial collaborative report of
23the Task Force's findings on the Commission's website. Members
24of the public and other interested parties shall have until

1February 1, 2023 to submit written comments with regard to the
2initial collaborative report. The Commission shall publish
3comments submitted by members of the public or other
4interested parties on its website.
5    (b) No later than March 31, 2023, the Task Force shall
6submit a final collaborative report of its findings to the
7Governor, the General Assembly, and the Illinois Student
8Assistance Commission. The Illinois Student Assistance
9Commission shall publish the final collaborative report of the
10Task Force's findings on the Commission's website.
11    (c) The Task Force is dissolved on March 31, 2024.
 
12    Section 90. Repeal. This Act is repealed on March 31,
132025.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
