HOUSE RESOLUTION

 
2    WHEREAS, A Petition was filed by Representative Jim Durkin
3with the Clerk of the House of Representatives on February 4,
42020, challenging the qualifications of Representative Eva
5Dina Delgado; and
 
6    WHEREAS, A Petition was filed by Representative Anne
7Stava-Murray with the Clerk of the House of Representatives on
8February 4, 2020, challenging the qualifications of
9Representative Eva Dina Delgado; and
 
10    WHEREAS, An Amended Petition was filed by Representative
11Jim Durkin with the Clerk of the House of Representatives on
12February 27, 2020, challenging the qualifications of
13Representative Eva Dina Delgado; and
 
14    WHEREAS, Representative Delgado was elected as the
15Illinois House Representative for the Third District on
16November 3, 2020; and
 
17    WHEREAS, The two petitioners either failed to prosecute or
18withdrew their respective petitions in December 2020; and
 
19    WHEREAS, A Petition for Attorney's Fees and Costs
20requesting reimbursement was filed by Miller Shakman Levine &

1Feldman LLP, as counsel for Representative Delgado, with the
2Clerk of the House of Representatives on January 5, 2021; and
 
3    WHEREAS, The One Hundred Second General Assembly commenced
4on January 13, 2021; and
 
5    WHEREAS, An Amended Petition for Attorney's Fees and Costs
6in the sum of $31,798 was filed by Miller Shakman Levine &
7Feldman LLP, as counsel for Representative Delgado, with the
8Clerk of the House of Representatives on March 4, 2021; and
 
9    WHEREAS, On May 10, 2021, the House Judiciary-Civil
10Committee held a subject matter hearing on the Amended
11Petition for Attorney's Fees and Costs pursuant to House Rule
1288(g); and
 
13    WHEREAS, On May 12, 2021, House Judiciary-Civil Committee
14received a supplemental declaration from Miller Shakman Levine &
15 Feldman LLP, which has been duly considered as part of the
16record in ascertaining what fees and expenses are proper under
17the terms of engagement, consistent with work performed, and
18for the purpose of ascertaining what fees and expenses are
19reasonable, just, and proper under the circumstances;
20therefore, be it
 
21    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE

1HUNDRED SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
2the House does approve and adopt the recommendation of the
3House Judiciary-Civil Committee that reimbursement of
4attorney's fees and expenses for the sum of, and not to exceed,
5$25,246 in this matter are reasonable, just, and proper; and
6be it further
 
7    RESOLVED, That the House authorizes that reimbursement sum
8from any appropriations available for that purpose.
