AMENDMENT TO HOUSE BILL 5463

2    AMENDMENT NO. ______. Amend House Bill 5463, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Highway Code is amended by adding
6Section 9-112.6 as follows:
 
7    (605 ILCS 5/9-112.6 new)
8    Sec. 9-112.6. Vegetation control permit.
9    (a) The Department may provide for vegetation control on
10land or a right-of-way under its jurisdiction related to the
11visibility of a permitted or registered outdoor advertising
12sign or grant a permit for such work.
13    (b) The Department may issue rules to provide the
14standards and procedures for vegetation control, including,
15but not limited to, permit applications, permits, revocations,
16and the requirements for the replacement of vegetation and

1landscaping removal to establish clear visibility zones of
2signs along highways in the State under its jurisdiction.
3    (c) The Department shall allow the cutting or trimming of
4vegetation to clear a visibility zone 250 feet in front of a
5single-sided sign and 250 feet in front of each side of a
6double-sided sign. The visibility zone for signs shall also
7include an additional 250-foot triangular section measured
8diagonally from the edge of the right-of-way to the edge of
9pavement. This distance shall be measured from the edge of the
10sign face closest to the pavement in a direction parallel to
11the pavement. All cutting or trimming of vegetation shall
12maintain environmental compliance and in no event shall the
13cutting or trimming of vegetation violate safety rules of the
14Department.
15    (d) The Department shall process a completed vegetation
16control application within 45 days of receiving such an
17application.
 
18    Section 99. Effective date. This Act takes effect 3 months
19after becoming law.".
