1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Employee Washroom Act is amended by adding
5Section 0.05 as follows:
 
6    (820 ILCS 230/0.05 new)
7    Sec. 0.05. Federal regulations; operation of Act.
8    (a) Except as provided in subsection (b), Sections 1
9through 5 of this Act are inoperative on and after the
10effective date of this amendatory Act of the 102nd General
11Assembly.
12    (b) If at any time the Occupational Safety and Health
13standard at 29 CFR 1910.141 is repealed or revoked, the
14Director of Labor shall adopt a rule setting forth a
15determination that this Act should be reviewed and reinstated
16in order to protect the health and safety of Illinois'
17workers. On the date such a rule is adopted, this Act shall
18again become operative.
 
19    Section 10. The Work Under Compressed Air Act is amended
20by adding Section 1.5 as follows:

1    Sec. 1.5. Federal regulations; operation of Act.
2    (a) Except as provided in subsection (b), Sections 1
3through 6 of this Act are inoperative on and after the
4effective date of this amendatory Act of the 102nd General
5Assembly.
6    (b) If at any time the Safety and Health Regulations for
7Construction standards at 29 CFR 1926.800 through 29 CFR
81926.804 are repealed or revoked, the Director of Labor shall
9adopt a rule setting forth a determination that this Act
10should be reviewed and reinstated, in whole or in part, in
11order to protect the health and safety of Illinois' workers.
12On the date such a rule is adopted, this Act shall again become
13operative.
 
14    Section 15. The Underground Sewer Employee Safety Act is
15amended by changing Section 1 and by adding Section 0.05 as
16follows:
 
17    (820 ILCS 250/0.05 new)
18    Sec. 0.05. Federal regulations; operation of Act.
19    (a) Except as provided in subsection (b), Sections 1
20through 6 of this Act are inoperative on and after the
21effective date of this amendatory Act of the 102nd General
22Assembly.
23    (b) If at any time the Occupational Safety and Health
24standards at 29 CFR 1910.120, 29 CFR 1910.146 or the Safety and

1Health Regulations for Construction standards 29 CFR 1926.1201
2through 29 CFR 1926.1213 are repealed or revoked, the Director
3of Labor shall adopt a rule setting forth a determination that
4this Act should be reviewed and reinstated, in whole or in
5part, in order to protect the health and safety of Illinois'
6workers. On the date such a rule is adopted, this Act shall
7again become operative.

9    Sec. 1. This Act shall apply to all employers engaged in
10any occupation, business or enterprise in this State,
11including the State of Illinois and its political
12subdivisions, except that in the event of a conflict between
13this Act and any other Federal or State law or regulation
14concerning health and safety of employees, such other law or
15regulation shall control.

17    Section 20. The Toxic Substances Disclosure to Employees
18Act is amended by changing Section 1.5 as follows:

20    Sec. 1.5. Federal regulations; operation of Act.
21    (a) Except as provided in subsection (b), Sections 2
22through 17 of this Act are inoperative on and after the
23effective date of this amendatory Act of the 102nd 95th

1General Assembly, and the Department of Labor shall instead
2enforce the Occupational Safety and Health Administration
3Hazard Communication standards at 29 CFR 1910.1200, as
4amended.
5    (b) If at any time the Occupational Safety and Health
6Administration Hazard Communication standard at 29 CFR
71910.1200 is repealed or revoked, the Director of Labor shall
8adopt a rule setting forth a determination that this Act
9should be reviewed and reinstated in order to protect the
10health and safety of Illinois' public sector workers. On the
11date such a rule is adopted, this Act shall again become
12operative.
