SYNOPSIS AS INTRODUCED:

    Amends the Election Code. Provides that the date of the general election on the first Tuesday after the first Monday of November in even years (rather than November 8, 2022) shall be a State holiday known as General Election Day and shall be observed throughout the State. Makes conforming changes. Removes a repeal date of January 1, 2023 for the provisions. Amends the Illinois Procurement Code, School Code, and State Universities Civil Service Act making conforming changes. Effective immediately.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Section 2A-1.1c as follows:
 
6    (10 ILCS 5/2A-1.1c)
7    (Section scheduled to be repealed on January 1, 2023)
8    Sec. 2A-1.1c. General 2022 Election Day State holiday.
9Notwithstanding any other provision of State law to the
10contrary, the date of the general election on the first
11Tuesday after the first Monday of November in even years
12November 8, 2022 shall be a State holiday known as 2022 General
13Election Day and shall be observed throughout the State.
14General Election Day is November 8, 2022 shall be deemed a
15legal school holiday for purposes of the School Code and State
16Universities Civil Service Act. Any school closed for General
17Election Day under this amendatory Act of the 102nd General
18Assembly and Section 24-2 of the School Code shall be made
19available to an election authority as a polling place for 2022
20General Election Day.
21    This Section is repealed on January 1, 2023.

1    Section 10. The Illinois Procurement Code is amended by
2changing Section 15-45 as follows:
 
3    (30 ILCS 500/15-45)
4    Sec. 15-45. Computation of days. The time within which any
5act provided in this Code is to be done shall be computed by
6excluding the first day and including the last, unless the
7last day is Saturday or Sunday or is a holiday, and then it
8shall also be excluded. If the day succeeding a Saturday,
9Sunday, or holiday is also a holiday, a Saturday, or a Sunday,
10then that succeeding day shall also be excluded. For the
11purposes of this Code, "holiday" means: New Year's Day; Dr.
12Martin Luther King, Jr.'s Birthday; Lincoln's Birthday;
13President's Day; Memorial Day; Juneteenth National Freedom
14Day; Independence Day; Labor Day; Columbus Day; General
15Election Day; Veterans' Day; Thanksgiving Day; Christmas Day;
16and any other day from time to time declared by the President
17of the United States or the Governor of Illinois to be a day
18during which the agencies of the State of Illinois that are
19ordinarily open to do business with the public shall be closed
20for business.
21    Notwithstanding any other provision of State law to the
22contrary, November 3, 2020 shall be a State holiday known as
232020 General Election Day and shall be observed throughout the
24State pursuant to this amendatory Act of the 101st General
25Assembly.

3    Section 15. The School Code is amended by changing Section
424-2 as follows:
 
5    (105 ILCS 5/24-2)  (from Ch. 122, par. 24-2)
6    Sec. 24-2. Holidays.
7    (a) Teachers shall not be required to teach on Saturdays,
8nor, except as provided in subsection (b) of this Section,
9shall teachers or other school employees, other than
10noncertificated school employees whose presence is necessary
11because of an emergency or for the continued operation and
12maintenance of school facilities or property, be required to
13work on legal school holidays, which are January 1, New Year's
14Day; the third Monday in January, the Birthday of Dr. Martin
15Luther King, Jr.; February 12, the Birthday of President
16Abraham Lincoln; the first Monday in March (to be known as
17Casimir Pulaski's birthday); Good Friday; the day designated
18as Memorial Day by federal law; June 19, Juneteenth National
19Freedom Day; July 4, Independence Day; the first Monday in
20September, Labor Day; the second Monday in October, Columbus
21Day; the first Tuesday after the first Monday of November in
22even years, General Election Day; November 11, Veterans' Day;
23the Thursday in November commonly called Thanksgiving Day; and
24December 25, Christmas Day. School boards may grant special

1holidays whenever in their judgment such action is advisable.
2No deduction shall be made from the time or compensation of a
3school employee on account of any legal or special holiday.
4    (b) A school board or other entity eligible to apply for
5waivers and modifications under Section 2-3.25g of this Code
6is authorized to hold school or schedule teachers' institutes,
7parent-teacher conferences, or staff development on the third
8Monday in January (the Birthday of Dr. Martin Luther King,
9Jr.); February 12 (the Birthday of President Abraham Lincoln);
10the first Monday in March (known as Casimir Pulaski's
11birthday); the second Monday in October (Columbus Day); and
12November 11 (Veterans' Day), provided that:
13        (1) the person or persons honored by the holiday are
14    recognized through instructional activities conducted on
15    that day or, if the day is not used for student attendance,
16    on the first school day preceding or following that day;
17    and
18        (2) the entity that chooses to exercise this authority
19    first holds a public hearing about the proposal. The
20    entity shall provide notice preceding the public hearing
21    to both educators and parents. The notice shall set forth
22    the time, date, and place of the hearing, describe the
23    proposal, and indicate that the entity will take testimony
24    from educators and parents about the proposal.
25    (c) Commemorative holidays, which recognize specified
26patriotic, civic, cultural or historical persons, activities,

1or events, are regular school days. Commemorative holidays
2are: January 17 (the birthday of Muhammad Ali), January 28 (to
3be known as Christa McAuliffe Day and observed as a
4commemoration of space exploration), February 15 (the birthday
5of Susan B. Anthony), March 29 (Viet Nam War Veterans' Day),
6September 11 (September 11th Day of Remembrance), the school
7day immediately preceding Veterans' Day (Korean War Veterans'
8Day), October 1 (Recycling Day), October 7 (Iraq and
9Afghanistan Veterans Remembrance Day), December 7 (Pearl
10Harbor Veterans' Day), and any day so appointed by the
11President or Governor. School boards may establish
12commemorative holidays whenever in their judgment such action
13is advisable. School boards shall include instruction relative
14to commemorated persons, activities, or events on the
15commemorative holiday or at any other time during the school
16year and at any point in the curriculum when such instruction
17may be deemed appropriate. The State Board of Education shall
18prepare and make available to school boards instructional
19materials relative to commemorated persons, activities, or
20events which may be used by school boards in conjunction with
21any instruction provided pursuant to this paragraph.
22    (d) City of Chicago School District 299 shall observe
23March 4 of each year as a commemorative holiday. This holiday
24shall be known as Mayors' Day which shall be a day to
25commemorate and be reminded of the past Chief Executive
26Officers of the City of Chicago, and in particular the late

1Mayor Richard J. Daley and the late Mayor Harold Washington.
2If March 4 falls on a Saturday or Sunday, Mayors' Day shall be
3observed on the following Monday.
4    (e) Notwithstanding any other provision of State law to
5the contrary, November 3, 2020 shall be a State holiday known
6as 2020 General Election Day and shall be observed throughout
7the State pursuant to this amendatory Act of the 101st General
8Assembly. All government offices, with the exception of
9election authorities, shall be closed for General Election Day
10unless authorized to be used as a location for election day
11services or as a polling place.
12    Notwithstanding any other provision of State law to the
13contrary, November 8, 2022 shall be a State holiday known as
142022 General Election Day and shall be observed throughout the
15State under Public Act 102-15 this amendatory Act of the 102nd
16General Assembly.

20    Section 20. The State Universities Civil Service Act is
21amended by changing Section 45a as follows:

23    Sec. 45a. Except as provided in the second sentence of
24this Section, all officers and employees subject to this Act,

1shall have the following days as holidays, for which they
2shall receive their usual compensation: New Year's Day,
3January 1, Memorial Day, as determined by the law of the State
4of Illinois, Independence Day, July 4, Labor Day, the first
5Monday in September, General Election Day, the first Tuesday
6after the first Monday of November in even years, Thanksgiving
7Day, the fourth Thursday of November, Christmas Day, December
825, and five holidays to be designated by each college,
9university, agency and community college subject to this Act.
10Craft and trade employees subject to this Act shall be paid for
11all paid holidays included in their area agreement, and will
12be paid for all five holidays designated by their employer
13pursuant to this Section.
14    College, university, agency, and community college offices
15Notwithstanding any other provision of State law to the
16contrary, November 3, 2020 shall be a State holiday known as
172020 General Election Day and shall be observed throughout the
18State pursuant to this amendatory Act of the 101st General
19Assembly. All government offices, with the exception of
20election authorities, shall be closed on General Election Day
21unless authorized to be used as a location for election day
22services or as a polling place.
23    Notwithstanding any other provision of State law to the
24contrary, November 8, 2022 shall be a State holiday known as
252022 General Election Day and shall be observed throughout the
26State under this amendatory Act of the 102nd General Assembly.

2    Section 99. Effective date. This Act takes effect upon
3becoming law.
