SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-705 new

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that a public or private educational entity that offers credit-bearing vocational, career, or technical education and coursework to high school students through a learning program approved by the school district wherein the location of the course instruction takes place in a building or structure that is located on the campus of an institution of higher education or in a building or structure that is located on a site that is under the jurisdiction or control of the institution may not be required by the Department of Public Health to obtain asbestos testing or to implement an asbestos remediation or abatement plan for that building or structure if (i) the public or private educational entity is not associated or affiliated with the institution of higher education other than in the use of the building or structure for course instruction and (ii) the institution of higher education is in compliance with all State and federal asbestos testing, abatement, and remediation requirements for buildings or structures located on its campus or that are otherwise under the jurisdiction or control of the institution. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-705 as follows:
 
7    (20 ILCS 2310/2310-705 new)
8    Sec. 2310-705. Educational entity; asbestos.
9    (a) In this Section, "institution of higher education" or
10"institution" means any publicly or privately operated
11university, college, community college, junior college,
12business, technical, or vocational school, or other
13educational institution offering degrees and instruction
14beyond the secondary school level.
15    (b) Notwithstanding any other law to the contrary, a
16public or private educational entity that offers
17credit-bearing vocational, career, or technical education and
18coursework to high school students through a learning program
19approved by the school district wherein the location of the
20course instruction takes place in a building or structure that
21is located on the campus of an institution of higher education
22or in a building or structure that is located on a site that is
23under the jurisdiction or control of the institution may not

1be required by the Department to obtain asbestos testing or to
2implement an asbestos remediation or abatement plan for that
3building or structure if (i) the public or private educational
4entity is not associated or affiliated with the institution of

7higher education is in compliance with all State and federal

12    Section 99. Effective date. This Act takes effect upon
13becoming law.
