1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois and Michigan Canal Development Act
5is amended by changing Section 9 as follows:
 
6    (615 ILCS 45/9)  (from Ch. 19, par. 37.19)
7    Sec. 9.
8    (a) The Department of Natural Resources, upon proper
9application made thereto, is authorized, subject to the
10approval of the Governor, to sell, transfer, or convey Canal
11lands to any department or agency of the United States
12Government or transfer jurisdiction and control over such
13lands, pursuant to the provisions of Section 2705-550 of the
14Department of Transportation Law (20 ILCS 2705/2705-550), to
15any department or agency of the State of Illinois or convey to
16any political subdivision thereof, or any quasi public board
17or agency having present or immediate future need for said
18Canal land for public recreation, parks, historic sites, or
19other projects of public nature upon such terms as may be
20mutually agreed upon by the parties in interest if such sale,
21transfer or conveyance is in accordance with the master plan
22for the development and management of the Canal. Said
23transfer, sale, or conveyance shall contain such conditions

1and stipulations as the Department may deem necessary to
2preserve the best interest of the State of Illinois.
3    (b) With respect to canal lands conveyed to the City of
4Ottawa, Illinois by deed dated August 18, 1970, and recorded
5September 15, 1970, as Document #563847, all restrictions
6imposed by this Section and those imposed in the deed of
7conveyance are herewith removed.
