SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-72-5 new
30 ILCS 805/8.45 new

    Amends the Illinois Municipal Code. Provides that a municipality with a population of over 100,000 in the 2020 Federal decennial census shall adopt a tree planting plan that identifies areas of canopy loss and creates a plan for protection or expansion of the tree canopy in the municipality. Provides that the tree planting plan must be adopted and implemented no later than 10 years after the effective date of the amendatory Act and that the implementation of the tree planting plan must be completed no later than 20 years after the effective date of the amendatory Act. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-72-5 as follows:
 
6    (65 ILCS 5/11-72-5 new)
7    Sec. 11-72-5. Tree planting plan.
8    (a) A municipality with a population of over 100,000 in
9the 2020 Federal decennial census shall adopt a tree planting
10plan that identifies areas of canopy loss and creates a plan
11for protection or expansion of the tree canopy in the
12municipality. The tree planting plan must be adopted and
13implemented no later than 10 years after the effective date of
14this amendatory Act of the 102nd General Assembly. The
15implementation of the tree planting plan must be completed no
16later than 20 years after the effective date of this
17amendatory Act of the 102nd General Assembly.
18    (b) A home rule municipality with a population of over
19100,000 in the 2020 Federal decennial census may not adopt or
20implement a tree planning plan in a manner inconsistent with
21this Section. This Section is a limitation under subsection
22(i) of Section 6 of Article VII of the Illinois Constitution on
23the concurrent exercise by home rule units of powers and

1functions exercised by the State.
 
2    Section 90. The State Mandates Act is amended by adding
3Section 8.45 as follows:
 
4    (30 ILCS 805/8.45 new)
5    Sec. 8.45. Exempt mandate. Notwithstanding Sections 6 and
68 of this Act, no reimbursement by the State is required for
7the implementation of any mandate created by this amendatory
8Act of the 102nd General Assembly.
