SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. Provides that if the General Assembly fails to pass a State budget setting forth appropriations for the ensuing fiscal year on or before May 31 of the year in which such budget is submitted, such existing appropriations provided for the previous fiscal year shall be in effect in the new fiscal year and all subsequent fiscal years until amended or eliminated by the General Assembly. Effective upon being declared adopted.

3    RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to Section 2 of Article VIII of
9the Illinois Constitution as follows:

12    (ILCON Art. VIII, Sec. 2)
13SECTION 2. STATE FINANCE
14    (a) The Governor shall prepare and submit to the General
15Assembly, at a time prescribed by law, a State budget for the
16ensuing fiscal year. The budget shall set forth the estimated
17balance of funds available for appropriation at the beginning
18of the fiscal year, the estimated receipts, and a plan for
19expenditures and obligations during the fiscal year of every
20department, authority, public corporation and quasi-public
21corporation of the State, every State college and university,
22and every other public agency created by the State, but not of
23units of local government or school districts. The budget shall

1also set forth the indebtedness and contingent liabilities of
2the State and such other information as may be required by law.
3Proposed expenditures shall not exceed funds estimated to be
4available for the fiscal year as shown in the budget.
5    (b) The General Assembly by law shall make appropriations
6for all expenditures of public funds by the State.
7Appropriations for a fiscal year shall not exceed funds
8estimated by the General Assembly to be available during that
9year.
10    (c) If the General Assembly fails to pass a State budget
11setting forth appropriations for the ensuing fiscal year on or
12before May 31 of the year in which such budget is submitted,
13such existing appropriations provided for the previous fiscal
14year shall be in effect in the new fiscal year and all
15subsequent fiscal years until amended or eliminated by the
16General Assembly.

SCHEDULE
19    This Constitutional Amendment takes effect upon being
20declared adopted in accordance with Section 7 of the Illinois
21Constitutional Amendment Act.
