SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-15.5

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. The Department of Financial and Professional Regulation shall require each licensee to complete sexual harassment prevention training provided by the licensee's employer, the Department of Human Rights, or any continuing education provider authorized to provide continuing education under an Act administered by the Department in accordance of the Illinois Human Rights Act. Provides that the training shall be completed, at a minimum, prior to a licensee's renewal of his or her license. Provides that the Department shall not refuse to renew a license if a license does not complete the training requirements. Effective immediately.

1    AN ACT concerning professional regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law of
5the Civil Administrative Code of Illinois is amended by
6changing Section 2105-15.5 as follows:
 
7    (20 ILCS 2105/2105-15.5)
8    Sec. 2105-15.5. Continuing education; sexual harassment
9prevention training.
10    (a) The Department shall require each licensee to complete
11sexual harassment prevention training provided by the
12licensee's employer, the Department of Human Rights, or any
13continuing education provider authorized to provide continuing
14education under an Act administered by the Department in
15accordance with Section 2-109 of the Illinois Human Rights Act.
16The training shall be completed, at a minimum, prior to a
17licensee's renewal of his or her license. The Department shall
18not refuse to renew a license if a license does not complete
19the training requirements in this subsection (a). As used in
20this Section, "sexual harassment" means any unwelcome sexual
21advances or requests for sexual favors or any conduct of a
22sexual nature when: (i) submission to such conduct is made
23either explicitly or implicitly a term or condition of an

1individual's employment; (ii) submission to or rejection of
2such conduct by an individual is used as the basis for
3employment decisions affecting such individual; or (iii) such
4conduct has the purpose or effect of substantially interfering
5with an individual's work performance or creating an
6intimidating, hostile, or offensive working environment. For
7the purpose of this definition, "working environment" is not
8limited to a physical location that an employee is assigned to
9perform his or her duties and does not require an employment
10relationship.
11    (b) The Department may adopt rules for the implementation
12of this Section. For license renewals occurring on or after
13January 1, 2020 for a profession that has continuing education
14requirements, the required continuing education hours shall
15include at least one hour of sexual harassment prevention
16training.
17    (c) (Blank). The Department may adopt rules for the
18implementation of this Section.
