    Amends the Physical Therapy Act. Adds provision requiring that applicants for licensure as a physical therapist or physical therapist assistant shall submit their fingerprints for the purpose of criminal history records checks.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Physical Therapy Act is amended by
5adding Section 8.7 as follows:
 
6    (225 ILCS 90/8.7 new)
7    Sec. 8.7. Criminal history records background check. Each
8applicant for licensure under Sections 8 and 8.1 shall have his
9or her fingerprints submitted to the Illinois State Police in
10an electronic format that complies with the form and manner for
11requesting and furnishing criminal history record information
12as prescribed by the Illinois State Police. These fingerprints
13shall be transmitted through a live scan fingerprint vendor
14licensed by the Department. These fingerprints shall be checked
15against the Illinois State Police and Federal Bureau of
16Investigation criminal history record databases now and
17hereafter filed. The Illinois State Police shall charge
18applicants a fee for conducting the criminal history records
19check, which shall be deposited into the State Police Services
20Fund and shall not exceed the actual cost of the records check.
21The Illinois State Police shall furnish, pursuant to positive
22identification, records of Illinois convictions to the
23Department. The Department may require applicants to pay a

1separate fingerprinting fee, either to the Department or to a
2vendor designated or approved by the Department. The
3Department, in its discretion, may allow an applicant or
4licensee who does not have reasonable access to a designated
5vendor to provide his or her fingerprints in an alternative
6manner. The Department may adopt any rules necessary to
7implement this Section.
