AMENDMENT TO SENATE BILL 2462

2    AMENDMENT NO. ______. Amend Senate Bill 2462 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5adding Section 143.10d as follows:
 
6    (215 ILCS 5/143.10d new)
7    Sec. 143.10d. Homeowner's liability insurance.
8    (a) An insurer that issues a policy or contract insuring
9against liability for injury to any person or against liability
10for injury to or destruction of property, arising out of
11ownership or lease of residential one, 2, 3, or 4 dwelling real
12property, may cancel, charge, or impose an increased premium or
13rate for or refuse to issue or renew that kind of policy or
14contract based in whole or in part upon the harboring of a dog
15found to be vicious under Section 15 of the Animal Control Act
16upon the insured property.

1    (b) An insurer that issues a policy or contract insuring
2against liability for injury to any person or against liability
3for injury to or destruction of property, arising out of
4ownership or lease of residential one, 2, 3, or 4 dwelling real
5property, may not cancel, charge, or impose an increased
6premium or rate for or refuse to issue or renew that kind of
7policy or contract based in whole or in part upon the harboring
8of a specific breed of dog upon the insured property.
9    (c) This Section applies to policies and contracts of
10insurance, delivered, issued, or renewed on and after the
11effective date of this amendatory Act of the 101st General
12Assembly.
13    (d) An insurer may not ask or inquire about a specific
14breed of dog upon the insured property, but may ask or inquire
15about the number of dogs on the property and if they have been
16sterilized or deemed a dangerous dog or a vicious dog under the
17Animal Control Act before or after issuing a policy or contract
18insuring against liability for injury to a person or against
19liability for injury to or destruction of property, arising out
20of ownership, lease, or rental of residential one, 2, 3, or 4
21dwelling real property.".
