AMENDMENT TO SENATE BILL 2462

2    AMENDMENT NO. ______. Amend Senate Bill 2462 on page 1,
3line 5 by replacing "Section 143.10d" with "Sections 143.10d
4and 143.10e"; and
 
5on page 1, line 11, by replacing "or lease" with ", lease, or
6rental"; and
 
7on page 1, line 20, by replacing "or lease" with ", lease, or
8rental"; and
 
9on page 2, immediately below line 5, by inserting the
10following:
 
11    "(215 ILCS 5/143.10e new)
12    Sec. 143.10e. Claim information for a dog-related
13incident. An insurance company offering homeowner's insurance
14coverage or renter's insurance coverage that issues a policy or

1contract insuring against liability for injury to a person or
2injury to or destruction of property arising out of the
3ownership, lease, or rental of residential property shall, for
4any claim involving a dog-related incident, record
5circumstances relating to the incident, including, but not
6limited to:
7        (1) if the perceived breed of the dog is noted on the
8    claim, whether the determination of breed was based on
9    visual identification or other methods, such as American
10    Kennel Club registration or DNA testing, and, if the breed
11    was determined by visual identification, who made the
12    visual identification and the qualifications of the person
13    making the visual identification;
14        (2) the sex of the dog and whether the dog was spayed
15    or neutered;
16        (3) whether, at the time of the incident, the person or
17    domestic animal who was injured, attacked, or threatened by
18    the dog had breached an enclosure or structure in which the
19    dog was kept apart from the public and such person or
20    domestic animal was not authorized by the owner of the
21    premises to be within the enclosure or structure,
22    including, but not limited to, a gated, fenced-in area if
23    the gate was closed, whether locked or unlocked;
24        (4) for what purpose the person or domestic animal who
25    was injured, attacked, or threatened by the dog was on the
26    property, including, but not limited to, a resident,

1    invitee, licensee, trespasser, or other status;
2        (5) whether the dog was on a leash or a chain at the
3    time of the incident and whether the incident occurred
4    indoors or outdoors;
5        (6) whether the person injured by the dog was engaged
6    in teasing, tormenting, battering, assaulting, injuring,
7    or otherwise provoking the dog;
8        (7) the age and behavior of the victim when the
9    incident occurred;
10        (8) the exact location of the dog and the victim prior
11    to the incident;
12        (9) whether the incident occurred on the owner's
13    property or elsewhere;
14        (10) any training, past behavior, or medical
15    evaluations of the dog;
16        (11) whether the dog was declared dangerous or vicious
17    pursuant to the Animal Control Act;
18        (12) whether the person who was injured by the dog was
19    committing a crime upon the person or property of the owner
20    or keeper of the dog;
21        (13) whether the dog was protecting or defending
22    itself, its offspring, another domestic animal, or a person
23    from attack or assault; and
24        (14) the amount of any claim paid to the victim of the
25    dog-related incident.
26    This information shall be collected beginning on January 1,

12022 and shall be reported annually to the Department of
2Insurance and be made available on the Department's website.".
