AMENDMENT TO SENATE BILL 2438

2    AMENDMENT NO. ______. Amend Senate Bill 2438 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by adding Section
62605-615, and 2705-505.7 as follows:
 
7    (20 ILCS 2605/2605-615 new)
8    Sec. 2605-615. Blue Alert Advisory Program.
9    (a) A coordinated program known as the Blue Alert Advisory
10Program is established within the Illinois State Police. The
11purpose of the Blue Alert Advisory Program is to provide a
12regional system for the rapid dissemination of information
13regarding a person who has violated Section 31-6 of the
14Criminal Code of 2012 (escape). The Blue Alert Advisory Program
15shall apply to all persons that escape a correctional
16institution or facility as defined in Section 3-1-2 of the

1Unified Code of Corrections or escape from the custody of a
2sheriff or law enforcement officer or agency.
3    (b) The Illinois State Police shall inform all persons that
4are within a radius of 100 square miles of the correctional
5institution or facility or sheriff's office or law enforcement
6agency from which the person has escaped, through electronic
7communication devices, electronic messages signs on State
8highways, and any other medium deemed necessary by the Illinois
9State Police.
10    (c) Subject to appropriation, the Illinois State Police, in
11coordination with the Department of Corrections, shall develop
12and implement a community outreach program to promote awareness
13of the Blue Alert Advisory Program among applicable entities,
14including, but not limited to, chiefs of police, county
15sheriffs, and correctional institutions or facilities.
16    (d) The Illinois State Police shall establish an Escape
17Search Task Force no later than 90 days after the effective
18date of this amendatory Act of the 101st General Assembly to
19assist the Illinois State Police in development and deployment
20of the Blue Alert Advisory Program. The Task Force shall
21establish the criteria, which may include usage of Department
22of Transportation signs, under Section 2705-505.6 of the
23Department of Transportation Law of the Civil Administrative
24Code of Illinois. The Task Force shall monitor and review the
25implementation and operation of that program, including
26procedures, budgetary requirements, standards, and minimum

1requirements for the training of law enforcement personnel on
2how to interact appropriately and effectively with escaped
3persons. The Task Force shall also develop additional network
4and financial resources for use in the system. The Task Force
5shall include, but is not limited to, one representative from
6each of the following:
7        (1) the Illinois State Police;
8        (2) the Department of Corrections;
9        (3) the Illinois Law Enforcement Training Standards
10    Board;
11        (4) the Illinois Emergency Management Agency;
12        (5) the Secretary of State;
13        (6) the Department of Transportation;
14        (7) the Illinois State Toll Highway Authority;
15        (8) a State organization dedicated to enhancing
16    communication and cooperation between sheriffs;
17        (9) a State association of police chiefs and other
18    leaders of police and public safety organizations;
19        (10) a State association representing Illinois
20    publishers;
21        (11) a State association that advocates for the
22    broadcast industry;
23        (12) a representative of a large wireless telephone
24    carrier; and
25        (13) a representative of a small wireless telephone
26    carrier.

1    (e) The members of the Task Force designated in paragraphs
2(1) through (7) of subsection (d) shall be appointed by the
3head of the respective agency. The members of the Task Force
4designated in paragraphs (8) through (13) of subsection (d)
5shall be appointed by the Director of the Illinois State
6Police. The Director of the Illinois State Police, or his or
7her designee, shall serve as Chair of the Task Force.
8    (f) The Task Force shall meet at least twice a year and
9shall provide a report on the operations of the Blue Alert
10Advisory Program to the General Assembly and the Governor each
11year by June 30.
12    (g) The Blue Alert Advisory Coordinator is created under
13the Illinois State Police. The Blue Alert Advisory Coordinator
14shall, in conjunction with the members of the Task Force,
15assist the Illinois State Police and the Escape Search Task
16Force in the establishment of State standards and monitor the
17availability of federal and private funding that may become
18available to further the objectives of Blue Alert Advisory
19Program. The Illinois State Police shall provide technical
20assistance for the Coordinator from its existing resources.
21    (h) The Illinois State Police shall provide administrative
22and other support to the Task Force.
 
23    Section 10. The Department of Transportation Law of the
24Civil Administrative Code of Illinois is amended by adding
25Section 2705-505.7 as follows:

2    Sec. 2705-505.7. Blue Alert Advisory message signs. The
3Department of Transportation shall coordinate with the
4Illinois State Police in the use of electronic message signs on
5roads and highways to immediately provide critical information
6to the public concerning escaped persons, as allowed by federal
7guidelines.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.".
