SYNOPSIS AS INTRODUCED:

    Amends the Illinois Police Training Act. Provides that the Law Enforcement Training Assistance Fund is created as a nonappropriated State trust fund within the State treasury. Provides that all gifts, donations, and charitable contributions that are contributed by any public or private individual or entity to the Illinois Law Enforcement Training Standards Board for the purpose of supporting local law enforcement training shall be deposited into this Fund. Amends the Law Enforcement Intern Training Act. Creates the Correctional Officer Intern Program. To be eligible to participate, the person must meet the minimum criteria established by the Illinois Law Enforcement Training Standards Board that includes, but is not limited to, physical fitness standards, educational standards, psychological standards, being at least 21 years of age, of good character, and not convicted of a felony offense or other crime involving moral turpitude under the laws of this State or any other State that, if convicted in this State, would be punishable as a felony or a crime of moral turpitude. Provides that the Board shall require correctional interns to undertake, at a minimum, the same training requirements as established for correctional officers. Provides that the Board certificate reserved for correctional officers shall not be awarded until the correctional intern is employed, has successfully completed the State certification exam, and meets the requirements. Makes other conforming changes. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.891 as follows:
 
6    (30 ILCS 105/5.891 new)
7    Sec. 5.891. The Law Enforcement Training Assistance Fund.
 
8    Section 10. The Illinois Police Training Act is amended by
9adding Section 10.23 as follows:
 
10    (50 ILCS 705/10.23 new)
11    Sec. 10.23. Law Enforcement Training Assistance Fund. The
12Law Enforcement Training Assistance Fund is created as a
13nonappropriated State trust fund within the State treasury. All
14gifts, donations, and charitable contributions that are
15contributed by any public or private individual or entity to
16the Board for the purpose of supporting local law enforcement
17training shall be deposited into this Fund. All money in the
18Fund shall not be subject to appropriation and shall be used by
19the Board for the purpose of supporting local law enforcement
20training. Investment income that is attributable to the
21investment of moneys in the Law Enforcement Training Assistance

1Fund shall be retained in the Fund for the uses specified in
2this Section. The Fund is not subject to sweeps, administrative
3charge-backs, or any other fiscal or budgetary maneuver that
4would in any way transfer any amounts from Fund into any other
5fund of the State.
 
6    Section 15. The Law Enforcement Intern Training Act is
7amended by changing Sections 5, 10, 15, 20, and 25 and by
8adding Sections 22 and 23 as follows:

10    Sec. 5. Definitions. As used in this Act:
11    "Academy" means a school certified by the Illinois Law
12Enforcement Training Standards Board to provide basic training
13under Section 6 of the Illinois Police Training Act.
14    "Board" means the Illinois Law Enforcement Training
15Standards Board created by the Illinois Police Training Act.
16    "Correctional Intern" means a civilian who has met the
17requirements to enter the Correctional Intern Training Program
18and who is not employed as a correctional officer under the
19Illinois Police Training Act.
20    "Graduate Correctional Intern" means a civilian who has
21successfully completed the correctional intern training course
22and is not employed as a correctional officer under the
23Illinois Police Training Act.
24    "Law Enforcement Intern" means a civilian who has met the

1requirements to enter the Law Enforcement Intern Training
2Program and who is not employed as a law enforcement officer
3under the Illinois Police Training Act.
4    "Graduate Law Enforcement Intern" means a civilian who has
5successfully completed the law enforcement intern training
6course and is not employed as a law enforcement officer under
7the Illinois Police Training Act.
8    "Trainee" means a law enforcement intern who is enrolled in
9the Law Enforcement Intern Training Program.

12    Sec. 10. Initiation, administration, and conduct of
13program by Board. The Board may initiate, administer, and
14conduct the Law Enforcement Intern Training Program and the
15Correctional Officer Intern Program. The training for law
16enforcement interns shall be provided at any certified academy
17selected by the Board. The Board shall have the authority to
18establish enrollment limitations.

21    Sec. 15. Election to participate in the Law Enforcement
22Intern Training Program program. Any person may elect to apply
23to participate in the Law Enforcement Intern Training Program.
24To be eligible to participate, the person must meet the minimum

1criteria established by the Board that includes, but is not
2limited to, physical fitness standards, educational standards,
3psychological standards, 21 years of age, of good character,
4and not convicted of a felony offense or other crime involving
5moral turpitude under the laws of this State or any other State
6that, if convicted in this State, would be punishable as a
7felony or a crime of moral turpitude. Applicants shall be
8accepted for the program on a person by person basis and shall
9not take the place of or prevent a law enforcement officer from
10entering an academy class to meet the basic training
11requirements set forth in the Illinois Police Training Act.
12When reviewing applications, special consideration shall be
13given to persons who have been members of the Armed Forces of
14the United States in accordance with the Veterans Preference
15Act. The Board's investigators shall enforce the provisions of
16this Act to ensure compliance with the Act, including, but not
17limited to, administrating a criminal justice background check
18that includes State and federal criminal histories, conducting
19interviews, obtaining, by subpoena if necessary, investigative
20records, police records, personnel records, or other records
21that may be needed.
22    Nothing in this Act shall override or replace, preempt, or
23supersede, any hiring or selection standard, process,
24procedure, requirement, or mechanism established by any local
25governmental unit, or State statute or regulation that is in
26effect or amended hereafter.

3    Sec. 20. Law enforcement certification Certification;
4transition course. The Board shall require law enforcement
5interns to undertake, at a minimum, the same training
6requirements as established for law enforcement officers under
7the Illinois Police Training Act. The Board certificate
8reserved for law enforcement officers shall not be awarded
9until the law enforcement intern is employed, has successfully
10completed the State certification exam, and meets the
11requirements established by the Board. The Law Enforcement
12Intern Certificate shall be issued to the trainee following the
13successful completion of the course. The graduate law
14enforcement intern, if not employed as a law enforcement
15officer within 2 years after issuance of the law enforcement
16intern certificate, must then meet the requirements of the
17Illinois Police Training Act upon employment. A graduate law
18enforcement intern who is not employed within one year, but is
19hired within 2 years after completing the course, must
20successfully complete a transition course approved by the
21Illinois Law Enforcement Training Standards Board and again
22successfully complete the law enforcement State certification
23exam in order to obtain the Board's certificate reserved for
24law enforcement officers. The transition course shall consist
25of a minimum of 80 hours and shall be conducted at a Board

1certified academy.

4    Sec. 22. Election to participate in the Correctional

15Applicants shall be accepted for the program on a person by
16person basis and shall not take the place of or prevent a
17correctional officer from entering an academy class to meet the
18basic training requirements set forth in the Illinois Police
19Training Act. When reviewing applications, special
20consideration shall be given to persons who have been members
21of the Armed Forces of the United States in accordance with the
22Veterans Preference Act. The Board's investigators shall

18successful completion of the course. The graduate correctional
19intern, if not employed as a correctional officer within 2
20years after issuance of the correctional intern certificate,
21must then meet the requirements of the Illinois Police Training
22Act upon employment.

24    Sec. 25. Police Training Board Services Fund. The Board

1shall charge, collect, or receive fees, tuition, or moneys from
2persons electing to enter the Law Enforcement Intern Training
3Program or the Correctional Officer Intern Program equivalent
4to the costs of providing personnel, equipment, services, and
5training to law enforcement interns that, in the judgement of
6the Board, are in the best interest of the State.
7    All fees or moneys received by the Board under this Act
8shall be deposited in a special fund in the State Treasury to
9be known as the Police Training Board Services Fund. The moneys
10deposited in the Police Training Board Services Fund shall be
11appropriated to the Board for expenses of the Board for the
12administration and conduct of training.

14    Section 99. Effective date. This Act takes effect upon
