AMENDMENT TO SENATE BILL 1938

2    AMENDMENT NO. ______. Amend Senate Bill 1938 on page 2,
3line 13, by replacing "this Act" with "the portions of this Act
4containing the title, the enacting clause, the effective date,
5the appropriate Section or Sections containing the land
6descriptions of the property to be conveyed, and this Section";
7and
 
8on page 2, immediately below line 16, by inserting the
9following:
 
10    "Section 15. (a) The Director of the Department of Natural
11Resources, on behalf of the State of Illinois, is authorized to
12execute and deliver to the City of Wyoming, a municipality
13organized and existing under the laws of the State of Illinois,
14of the County of Stark, State of Illinois, for and in
15consideration of $1.00 paid to the Department, a quitclaim deed
16to the following described real property, to wit:

1    A tract conveyed to the State of Illinois, Department of
2    Conservation (now Department of Natural Resources
3    (Document Number 53205) described as Lot 1, Block 10; and
4    part of Lot 3, Block 9 in Dana's Addition to City of
5    Wyoming in Section l, Township 12 North, Range 6 East, of
6    the 46 Principal Meridian, Stark County, Illinois.
 
7    (b) The conveyance of real property shall be made subject
8to: (1) existing public utilities, existing public roads, and
9any and all reservations, easements, encumbrances, covenants,
10and restrictions of record; and (2) the express condition that
11if the real property ceases to be used for public purposes, it
12shall revert to the State of Illinois, Department of Natural
13Resources.
 
14    Section 20. (a) The Director of the Department of Natural
15Resources, on behalf of the State of Illinois, is authorized to
16execute and deliver to the City of Ottawa, a municipality
17organized and existing under the laws of the State of Illinois,
18of the County of LaSalle, State of Illinois, for and in
19consideration of $1.00 paid to the Department, a quitclaim deed
20to the following described real property, to wit:
 
21    That part of the Fox River Feeder Canal right of way South
22    of Union Addition to Ottawa, North of Railroad Addition to

6    Principal Meridian, City of Ottawa, LaSalle County,
7    Illinois, more particularly described as follows:
 
8    Commencing at an iron pin marking the Northeast corner of
9    Lot 1 of Block 3 of the Union Addition to Ottawa; thence
10    South 00 degrees 05 minutes 05 seconds West, 41.96 feet to
11    a stone marking the Southeast Corner of said Lot 1, also
12    being on the North right of way line of the Fox River
13    Feeder Canal, thence South 67 degrees 48 minutes 00 seconds

6    (b) The conveyance of real property shall be made subject
7to: (1) existing public utilities, existing public roads, and
8any and all reservations, easements, encumbrances, covenants,
9and restrictions of record; and (2) the right, title, and
10interest of the United States of America, if any, in and to any
11of the subject parcel as a reversionary interest or otherwise
12under Congressional Acts of March 30, 1822, March 25, 1827,
13July 1, 1947, and any others, if applicable.
 
14    Section 25. (a) The Director of the Department of Natural
15Resources, on behalf of the State of Illinois, is authorized to
16exchange certain real property in St. Clair County, Illinois,
17hereinafter referred to as Parcel 1, for certain real property
18of equal or greater value in St. Clair County, Illinois,

13both parties. Each party shall be responsible for any and all
14title costs associated with their respective properties.
 
15    Section 30. (a) The Director of the Department of Natural
16Resources, on behalf of the State of Illinois, is authorized to
17exchange certain real property in Pulaski County, Illinois,
18hereinafter referred to in this Section as Parcel 1, for
19certain real property of equal or greater value in Pulaski
20County, Illinois, hereinafter referred to in this Section as
21Parcel 2, the Parcels being described as follows:

11Section shall be made subject to existing public utilities,
12existing public roads, and any and all reservations, easements,
13encumbrances, covenants, and restrictions of record.
14    (d) The Director of the Department of Natural Resources
15shall obtain an opinion of title from the Attorney General
16certifying that the State of Illinois will receive merchantable
17title to the real property in this Section referred to as
18Parcel 2.
 
19    Section 35. The Director of Natural Resources shall obtain
20a certified copy of the portions of this Act containing the
21title, the enacting clause, the effective date, the appropriate
22Section or Sections containing the land descriptions of the
23property to be conveyed, and this Section within 60 days after

1its effective date and, upon receipt of the payment required by
2the Section or Sections, if any payment is required, shall
3record the certified document in the Recorder's Office in the
4County in which the land is located.".
