AMENDMENT TO SENATE BILL 1938

2    AMENDMENT NO. ______. Amend Senate Bill 1938 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. (a) The Director of the Department of Natural
5Resources, on behalf of the State of Illinois, is authorized to
6execute and deliver to the City of Wyoming, a municipality
7organized and existing under the laws of the State of Illinois,
8of the County of Stark, State of Illinois, for and in
9consideration of $1.00 paid to the Department, a quitclaim deed
10to the following described real property, to wit:
 
11    A tract conveyed to the State of Illinois, Department of
12    Conservation (now Department of Natural Resources
13    (Document Number 53205) described as Lot 1, Block 10; and
14    part of Lot 3, Block 9 in Dana's Addition to City of
15    Wyoming in Section l, Township 12 North, Range 6 East, of
16    the 46 Principal Meridian, Stark County, Illinois.

1    (b) The conveyance of real property shall be made subject
2to: (1) existing public utilities, existing public roads, and
3any and all reservations, easements, encumbrances, covenants,
4and restrictions of record; and (2) the express condition that
5if the real property ceases to be used for public purposes, it
6shall revert to the State of Illinois, Department of Natural
7Resources.
 
8    Section 10. (a) The Director of the Department of Natural
9Resources, on behalf of the State of Illinois, is authorized to
10execute and deliver to the City of Ottawa, a municipality
11organized and existing under the laws of the State of Illinois,
12of the County of LaSalle, State of Illinois, for and in
13consideration of $1.00 paid to the Department, a quitclaim deed
14to the following described real property, to wit:
 
15    That part of the Fox River Feeder Canal right of way South
16    of Union Addition to Ottawa, North of Railroad Addition to
17    Ottawa, East of the East right of way line of Columbus
18    Street (State Route 23) and West of the East right of way
19    line of Paul Street extended North to the South line of
20    Union Addition to Ottawa, all in the Southeast Quarter of
21    Section 2, Township 33 North, Range 3 East of the Third
22    Principal Meridian, City of Ottawa, LaSalle County,
23    Illinois, more particularly described as follows:

1    Commencing at an iron pin marking the Northeast corner of
2    Lot 1 of Block 3 of the Union Addition to Ottawa; thence
3    South 00 degrees 05 minutes 05 seconds West, 41.96 feet to
4    a stone marking the Southeast Corner of said Lot 1, also
5    being on the North right of way line of the Fox River
6    Feeder Canal, thence South 67 degrees 48 minutes 00 seconds
7    West along said North right of way line, 347.75 feet to the
8    intersection of said right of way line and East right of
9    way line of Paul Street extended North also being the Point
10    of Beginning; thence South 00 degrees 07 minutes 11 seconds
11    West, 102.38 feet to the Northwest corner of Lot 5 of Block
12    3 of the Railroad Addition of Ottawa, also being on the
13    South right of way line of the Fox River Feeder Canal;
14    thence South 67 degrees 25 minutes 17 seconds West along
15    said South right of way line, 370.18 feet to the East right
16    of way of Columbus Street (State Route 23); thence North 02
17    degrees 50 minutes 39 seconds East along said East right of
18    way, 107.24 feet to a point on the South line of Lot 16 of
19    Block 3 of Union Addition to Ottawa, also being the North
20    right of way line of the Fox River Feeder Canal; thence
21    North 67 degrees 48 minutes 00 seconds East, 363.66 feet to
22    the Point of Beginning, containing 0.81 acres, more or
23    less.
 
24    (b) The conveyance of real property shall be made subject

1to: (1) existing public utilities, existing public roads, and
2any and all reservations, easements, encumbrances, covenants,
3and restrictions of record; and (2) the right, title, and
4interest of the United States of America, if any, in and to any
5of the subject parcel as a reversionary interest or otherwise
6under Congressional Acts of March 30, 1822, March 25, 1827,
7July 1, 1947, and any others, if applicable.
 
8    Section 15. (a) The Director of the Department of Natural
9Resources, on behalf of the State of Illinois, is authorized to
10exchange certain real property in St. Clair County, Illinois,
11hereinafter referred to as Parcel 1, for certain real property
12of equal or greater value in St. Clair County, Illinois,
13hereinafter referred to as Parcel 2, the Parcels being
14described as follows:
 
15    PARCEL 1:
 
16    Legal Description: Part of a tract described in Warranty
17    Deed from the East St. Louis Park District to the People of
18    the State of Illinois, date May 1, 1946 and recorded May 3,
19    1946 in Book 1044, Page 532 St. Clair County, Illinois,
20    described more particularly as follows: Beginning at an
21    Iron Pin marking the location of a disturbed Stone
22    described in the description of said tract and being the
23    Southeasterly point of Lot 13 of the Final Subdivision Plat

1    (c) The Director of the Department of Natural Resources
2shall obtain an opinion of title from the Attorney General
3certifying that the State of Illinois will receive merchantable
4title to the real property referred to in this Section as
5Parcel 2.
6    (d) This transaction will be to the mutual advantages of
7both parties. Each party shall be responsible for any and all
8title costs associated with their respective properties.
 
9    Section 20. (a) The Director of the Department of Natural
10Resources, on behalf of the State of Illinois, is authorized to
11exchange certain real property in Pulaski County, Illinois,
12hereinafter referred to in this Section as Parcel 1, for
13certain real property of equal or greater value in Pulaski
14County, Illinois, hereinafter referred to in this Section as
15Parcel 2, the Parcels being described as follows:
 
16    PARCEL 1:
 
17    The North 106 feet of the following described tract of land
18    conveyed to the People of the State of Illinois, Department
19    of Natural Resources, Springfield, IL., by Warranty Deed
20    dated June 19, 2009, recorded June 25, 2009, Document No.
21    24582, in Book 257, Page 816, described as follows to-wit:
 
22    "A tract of land in the Southwest Quarter of the Northwest

1    Quarter of Section 14, Township 14 South, Range 1 East of
2    the 3rd P.M., more particularly described as follows:
3    Beginning at the Northwest corner of the Southwest Quarter

6    20 feet for a point of beginning; thence East a distance of
7    272 feet along a line parallel to the Northerly Section
8    line of said Quarter-Quarter Section; thence South a
9    distance of 320 feet and 3 inches on a line parallel to the
10    West Section line of said Quarter-Quarter Section; thence
11    West a distance of 272 feet along a line parallel to the
12    North line of said Southwest Quarter of the Northwest
13    Quarter; thence North a distance of 320 feet and 3 inches
14    following the Westerly line of said Quarter-Quarter
15    Section to the point of beginning, containing 2 acres, more

18    PARCEL 2:
 
19    The South 106 feet of the North 426.25 feet of the West 272
20    feet of the Southwest Quarter of the Northwest Quarter of
21    Section 14, Township 14 South, Range 1 East of the 3rd
22    P.M., situated in the County of Pulaski and State of

1    (b) The transaction under this Section will be to the
2mutual advantages of both parties. Each party shall be
3responsible for any and all title costs associated with their
4respective properties.
5    (c) The conveyance of Parcel 1 as authorized by this
6Section shall be made subject to existing public utilities,
7existing public roads, and any and all reservations, easements,
8encumbrances, covenants, and restrictions of record.
9    (d) The Director of the Department of Natural Resources
10shall obtain an opinion of title from the Attorney General
11certifying that the State of Illinois will receive merchantable
12title to the real property in this Section referred to as
13Parcel 2.
 
14    Section 25. The Director of Natural Resources shall obtain
15a certified copy of the portions of this Act containing the
16title, the enacting clause, the effective date, the appropriate
17Section or Sections containing the land descriptions of the
18property to be conveyed, and this Section within 60 days after
19its effective date and, upon receipt of the payment required by
20the Section or Sections, if any payment is required, shall
21record the certified document in the Recorder's Office in the
22County in which the land is located.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.".
