AMENDMENT TO SENATE BILL 1793

2    AMENDMENT NO. ______. Amend Senate Bill 1793 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. Findings. The General Assembly finds that the
5positions of fire chief and paramedic chief in the Chicago Fire
6Department are positions that require the knowledge and skill
7of experienced members of the Chicago Fire Department.
8Furthermore, the General Assembly finds that the positions of
9fire chief and paramedic chief are positions in which persons
10holding the fire chief and paramedic chief rank take command
11of, or otherwise give orders to, their subordinates at
12potentially dangerous or life-threatening incidents and
13activities.
 
14    Section 10. The Illinois Municipal Code is amended by
15adding Section 10-1-7.4 as follows:

1    (65 ILCS 5/10-1-7.4 new)
2    Sec. 10-1-7.4. Temporary fire chief and paramedic chief
3advisory board.
4    (a) As used in this Section, "fire chief" or "paramedic
5chief" means an individual temporarily appointed by the Fire
6Commissioner to have direct supervisory authority over sworn
7firefighters, paramedics, or emergency medical technicians of
8the Chicago Fire Department.
9    (b) A advisory board is created in the Chicago Fire
10Department to recommend to the Fire Commissioner of the Chicago
11Fire Department the best candidates for each position of fire
12chief or paramedic chief. The advisory board shall be comprised
13of 8 members appointed by the Fire Commissioner, or his or her
14designee, 4 of whom must be, at the time of appointment and
15during all times while serving on the advisory board: (i) a
16member of an organization representing the interest of
17firefighters and paramedics of the Chicago Fire Department; and
18(ii) elected at large by members of that organization to the
19organization's executive board. The Fire Commissioner shall
20make his or her initial appointments to the advisory board no
21later than 60 days after the effective date of this amendatory
22Act of the 101st General Assembly. The advisory board shall
23meet no later than 90 days after the effective date of this
24amendatory Act of the 101st General Assembly to elect a chair
25and vice-chair. Beginning June 1, 2020, and every June 1
26thereafter, members shall be appointed or reappointed to

1one-year terms and each newly-appointed advisory board shall
2meet no later than July 1 of each year to elect a chair and
3vice-chair.
4    (c) The Fire Commissioner shall provide written notice to
5the advisory board each time the Fire Commissioner will need to
6make an appointment of a fire chief or paramedic chief. The
7Fire Commissioner must provide with the written notice to the
8advisory board a list of candidates for each position that he
9or she will need to make an appointment, including which
10candidates meet the criteria under subsection (d). The advisory
11board shall meet no later than 30 days after receipt of each
12written notice from the Fire Commissioner and shall issue a
13recommendation or recommendations to the Fire Commissioner no
14later than 15 days after the initial meeting. In order to be
15recommended for the position of fire chief or paramedic chief,
165 members of the advisory board must agree to the
17recommendation.
18    (d) The Fire Commissioner may appoint a fire chief or
19paramedic chief after the advisory board has issued its
20recommendation under subsection (c). An individual appointed
21fire chief or paramedic chief by the Fire Commissioner should
22meet the following criteria:
23        (1) is an active member of the Chicago Fire Department
24    who is not receiving any type of pension from the Firemen's
25    Annuity and Benefit Fund of Chicago;
26        (2) has 10 years of creditable service time with the

1    Chicago Fire Department;
2        (3) has held the career service rank of battalion chief
3    or field chief with the Chicago Fire Department prior to
4    his or her appointment to the rank of fire chief or
5    paramedic chief; and
6        (4) does not exceed the maximum age set forth in the
7    ordinances of the City of Chicago that govern active sworn
8    members of the Chicago Fire Department.
9    However, the Fire Commissioner may appoint any individual
10recommended by the advisory board under subsection (c) even if
11they do not meet the criteria in this subsection.
12    (e) The advisory board shall adopt all necessary rules and
13procedures it finds necessary to carry out the process of
14recommending qualified candidates. The City of Chicago shall
15provide administrative and other support to the advisory board.
16    (f) The City of Chicago may not regulate the advisory board
17or regulate appointments of fire chiefs or paramedic chiefs in
18the Chicago Fire Department in a manner inconsistent with this
19Section. This Section is a limitation under subsection (i) of
20Section 6 of Article VII of the Illinois Constitution on the
21concurrent exercise by home rule units of powers and functions
22exercised by the State.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.".
